The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant’s award request pertaining to the CIB is supported by sufficient evidence; therefore, it will be administratively corrected and not considered by the Board. The Board will consider his SSN request 3. The applicant states his SSN was entered incorrectly when he was processed. 4. The applicant provides: * DD Form 214 which shows his SSN ending in XXXX in item 3 * Certificate of Birth issues on showing his name and date of birth, as well as name of his parents * Social Security Card which is not clearly legible due to quality of photocopy or scan * VA letter informing him his DD Form 149 was returned because the VA does not process those changes, which must be directed to the Board * self-written cover letter in which he states he faxed paperwork to a fax number, but no one seems to know what happened to the transaction 5. A review of the applicant’s service records shows: * DA Form 20 (Enlisted Qualification Record), wherein his SSN is listed as “XXX XX XXXX” in the upper left corner and reviewed and was signed by him on 30 January 1968 * DD Form 398 (Statement of Personal History) in which appears the applicant filled in his SSN as XXX-XX-XXXX in item 13 (Employment) * DA Form 3027 (US Army Request for National Agency Check) wherein he filled in by hand his SSN as “XXX-XX-XXXX” in item 4 (Social Security Number) 6. His service records are void of any documents or orders which show he used or listed the SSN “XXX-XX-XXXX.” 7. Army Regulation 635-5 (Separation Documents), in effect at the time, established the standardized policy for preparing and distributing the DD Form 214. The regulation directs that the purpose of the separation document is to provide the individual with documentary evidence of his or her military service. It is important that information entered on the form should be complete and accurate. With regard to item 3, the regulation required verification of accuracy with the SSN of record. BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents and evidence in the records. The Board discussed his period of service, use of the Service Number, and the reversal of two numbers in his current SSN. The Board majority determined that an error may have occurred during his entry into service and a correction was warranted; one member did not concur with that change. The Board concurred with the administrative correction regarding the CIB as noted below. 2. After reviewing the application and all supporting documents, the Board found that relief was warranted. ADMINISTRATIVE NOTE(S): Reference the enclosed request to add the Combat Infantryman Badge to the applicant’s DD Form 214 ending 29 March 1968. A review of his service records contains the documents listed below which are sufficient to substantiate correction without action from the Board: • Special Orders Number 48 issued by Headquarters, 9th Infantry Division, on 17 February 1967 shows he was awarded the CIB • DA Form 20 shows in item 41 (Award and Decorations) the CIB was awarded REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), in effect at the time, established the standardized policy for preparing and distributing the DD Form 214.
