ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 19 August 2019 DOCKET NUMBER: AR20180002472 APPLICANT REQUESTS: that his DD 214 (Armed Forces of the United States Report of Transfer or Discharge) reflect his Combat Infantryman Badge (CIB), U.S Army Reserve (USAR) Components Achievement Medal (ARCAM) and any other awards and decorations that are not listed. APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: DD Form 149 (Application for Correction of Military Record) FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states that he would like his CIB, USAR GCM and any other award or decorations that he is authorized to be added to his DD Form 214. 3. A review of the applicant’s service record shows the following: a. The DD Form 4 (Enlistment/Reenlistment Document) for his initial enlistment is not available for review. However, the DD Form 398-2 (National Agency Questionnaire) reflects that the applicant enlisted in the Regular Army (RA) from 1 April 1966 to 2 January 1969, Army National Guard (ARNG) from 9 January 1978 to 8 January 1982, and the U.S Army Reserve (USAR) from 12 January 1989 to 5 April 1989. b. Special Orders 91, dated 31 March 1968, awards the applicant the CIB. c. General Orders Number 11169, dated 8 December 1968, awards the applicant the Army Commendation Medal for the period of January 1968 to October 1968 for service in Vietnam with Headquarters and Headquarters Company, 9th Infantry Division. d. He was transferred to the USAR on 2 January 1969 with an honorable character of service. He served a total of 2 years, 9 months, and 2 days (Block 22 b). He also had 1 year, 10 months, and 15 days of Foreign Service (Block 22 c). His DD 214 shows that he was awarded or authorized: * National Defense Service Medal * Vietnam Service Medal * Vietnam Campaign Medal e. NGB Form 22 (Report of Separation and Record of Service) discharges the applicant on 8 January 1982 with an honorable character of service. He has 4 years of service. He was awarded or authorized * California National Guard Drill Attendance Ribbon (CADAR) * California Good Conduct Medal * Marksmanship Qualification Badge (M16) f. He reenlisted in the Army National Guard (ARNG) on 30 June 1993. g. Orders 151-505, dated 8 August 1994, discharges the applicant from the ARNG with an effective date of 4 August 1994 with an honorable character of service. h. NGB Form 22 discharges the applicant on 4 August 1994 with an honorable character of service. He had 14 years, 5 months, and 19 days of prior reserve component service (Block 10b). The authority and reason stated was that an ARNG unit was not within reasonable commute. He was awarded or authorized the National Defense Service Medal. i. After an exhaustive search of the applicant’s service records, no documentation, or awards were found that awarded the applicant the Army Reserve Components Achievement Medal for his USAR service. 4. Army Regulation (AR) 600-8-22 (Military Awards) states Army Reserve Components Achievement Medal (ARCAM) was established by the SECARMY on 3 March 1971 (AGO 1971–30), and amended by AGO 1974–4. It is awarded for exemplary behavior, efficiency, and fidelity while serving as a member of an ARNG unit or USAR TPU or as an IMA. The ARCAM is authorized for award to Army personnel in the rank of COL/O–6 and below. The individual must have been a member of an ARNG unit or USAR TPU. The medal is also awarded to USAR Soldiers serving as IMAs after completing qualifying service and on recommendation of the unit commander or HQDA official to which the IMA is assigned. AGR Soldiers and officers are not authorized award of the ARCAM. AGR Soldiers (enlisted) are eligible for the AGCM under the provisions of paragraph 4–2. 5. AR 600-8-22, paragraph 4-18, states that a. Effective 28 March 1995, the period of qualifying service for award of the ARCAM was reduced from 4 years to 3 years. That is, Soldiers completing 3 years of qualified service on or after 28 March 1995 are eligible for ARCAM consideration. This change is not retroactive. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined relief was warranted. Based upon the documentary evidence provided by the applicant and found within the military service record, the Board concluded that the applicant was eligible and should be awarded the Army Good Conduct Medal (1st Award). Additionally, the Board noted the administrative notes below from the analyst of record and recommended those changes also be completed to more accurate depict the military service of the applicant. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Qualifying service for computation purposes is based only by retirement ending year dates. b. Effective 28 March 1995, the period of qualifying service for award of the ARCAM was reduced from 4 years to 3 years. That is, Soldiers completing 3 years of qualified service on or after 28 March 1995 are eligible for ARCAM consideration. This change is not retroactive. 4. Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) lists the awards received by units serving in Vietnam. This pamphlet shows the unit to which the applicant was assigned was cited for award of the Republic of Vietnam Gallantry Cross with Palm Unit Citation for the period 1 December 1966 to 30 January 1968 by Department of the Army General Order Number 31, dated 1969. 5. Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) lists the awards received by units serving in Vietnam. This pamphlet shows the unit to which the applicant was assigned was cited for award of the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation for the period 19 December 1966 to 28 June 1969 by Department of the Army General Order Number 59, dated 1969. 6. Army Regulation 600-8-22 (Military Awards) states the Presidential Unit Citation (known as the Distinguished Unit Citation until 3 November 1966) is awarded for extraordinary heroism in action. A unit must display such gallantry, determination, and esprit de corps in accomplishing its mission as would warrant award of the Distinguished Service Cross to an individual.
