APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: .DD Form 149 (Application for Correction of Military Record) .Headquarters, III Corps and Fort Hood Orders 109-0112, dated 19 April 2017 .DD Form 214 FACTS: 1.The applicant states his DD Form 214 should reflect his rank as CSM instead ofSGM, as his retirement orders show CSM. 2.The applicant enlisted in the Regular Army on 22 May 1989. 3.His Enlisted Record Brief shows the following: .his rank was SGM .his date of rank for promotion to SGM was 1 June 2010 .his duty title was CSM from 11 March 2009 through 25 February 2016 .his duty title was Senior Logistics Operations Noncommissioned Officer (NCO)from 26 February 2016 through 10 July 2017 .his duty title was known losses from 11 July 2017 through his retirement 4.The applicant’s DA form 2166-9-3 (NCO Evaluation Report (CSM/SGM)) (NCOER), covering the period 20 February 2016 through 18 February 2017, the last NCOER on file for him, shows his principal duty title was G-4 SGM. 5.Headquarters III Corps and Fort Hood Orders 109-0112, dated 19 April 2017 refer to the applicant as a SGM in the first line of the orders as well as list his retired grade/rank as CSM. 6.His DD Form 214 shows he was retired due to length of service on 31 December2017, after 28 years, 7 months, and 9 days of net active service. Item 4a lists his rankas SGM.BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found that relief is not warranted. The applicant’s NCOER ending 20170218 showed the applicant’s rank as SGM. Headquarters III Corps and Fort Hood Orders 109-0112, dated 19 April 2017, refer to the applicant as a SGM in the first line of the orders. There is documentary evidence that the applicant served as a CSM and therefore the entry on the retirement orders for retired rank is correct. However, the rank the applicant was serving in at the time of his separation from active duty was SGM. That rank is correctly reflected on the DD Form 214 at the time of the applicant's retirement. Based on a preponderance of evidence, the Board determined that the rank shown on the applicant's DD form 214 is not in error or unjust. REFERENCES: 1.Army Regulation 614-200 (Enlisted Assignments and Utilization) provides guidanceon the selection of enlisted Soldiers for assignment, utilization, reclassification, detail,transfer and training. a.Paragraph 7-5 pertains to lateral appointments for CSM or SGM. Wearing ofCSM rank requires formal selection by an appropriate Headquarters Department of the Army selection board, without exception. Soldiers will wear CSM or SGM rank commensurate with the duties to which they are assigned and serving. Soldiers serving in an authorized CSM position will wear CSM rank and Soldiers serving in an authorized SGM position will wear SGM rank. b. The effective date of lateral appointment to CSM is the date the Soldier assumes CSM duties. The date of rank remains unchanged. c. The effective date of lateral appointment to SGM is the day after the Soldier completes the preceding CSM assignment, typically the projected change of responsibility date. The date of rank remains unchanged. 2. Army Regulation 635-8 (Separation Processing and Documents) prescribes policy and procedural guidance relating to transition management, to include the preparation and issuance of the DD Form 214. a. The DD Form 214 is a summary of the Soldier’s most recent period of continuous active duty and provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. b. The following source documents will be used from the Soldier’s record to complete the DD Form 214: . service member’s record brief (computer generated) . separation approval documents, if applicable . separation order . any other document authorized for filing in the Official Military Personnel File c. The rules for completing the DD Form 214 state for block 4 (Grade, Rate, or Rank) to verify that active duty grade or rank and pay grade are accurate at the time of separation. //NOTHING FOLLOWS//
