The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his SSN is incorrect on his Reserve letter orders and discharge certificate and is unable to use his afforded benefits as a result of his service. 3. The applicant enlisted in the United States Army Reserve (USAR) on 17 July 1968. His DD Form 4 (Enlistment Contract) shows his requested SSN. 4. The applicant was ordered to active duty for training on 13 January 1969 and after completion of military occupational specialty training was honorably released from active duty and transferred back to his USAR on 26 May 1969. Item 3 (SSN) of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) shows his requested SSN. 5. The applicant provides: a. 6AA Form 5, dated 22 August 1974 shows he was discharged from the USAR effective 22 August 1974. These orders show his SSN as "XXX-XX-XXXX." b. DD Form 256A, dated 22 August 1974 shows his SSN as "XXX-XX-XXXX." c. A social security card that shows his SSN as "XXX-XX-XXXX." 6. Army Regulation 635-5 (Separation Documents), dated 23 May 1972, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It stated to transcribe the SSN at the time of separation from applicable documents in item 3. BOARD DISCUSSION: The Board considered the applicant’s request with all supporting documents, evidence in the service record and applicable policies and guidance. The applicant’s DD Form 4 (Enlistment Contract), dated 17 July 1968 and his DD Form 214, dated 26 May 1967 show his SSN as XXX-XX-XXX, as reflected on the applicant’s SSN card. The preponderance of evidence reflects the correction of the applicant’s 6AA Form 5 (Reserve Letter Orders Number D-8-310) and DD Form 256A (Honorable Discharge Certificate) should show his SSN as "XXX-XX-XXX" instead of "XXX-XX-XXXX. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his 6AA Form 5, dated 22 August 1974 and his DD Form 256A by deleting the current SSN shown and replacing it with the SSN shown on his social security card. ADMINISTRATIVE NOTE(S): Not Applicable REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separations Documents), dated 23 May 1972, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge.
