The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states she entry date on her DD Form 214 is incorrect and she would like it corrected. 3. The applicant provides: a. A copy of her DD Forms 4 showing she enlisted in the Army Reserves on 19 April 1980. b. A copy of her DD Form 214 shows she entered Regular Army (RA) on 7 April 1983 and was discharged on 1 February 1985 with 2 years, 8 months and 28 days of total prior active service. c. A copy of her discharge order with an effective date of 1 February 1985. d. A copy of her Good Conduct Medal covering the period of 9 July 1980 through 8 July 1983. 4. A review of the applicant’s service record shows: a. She enlisted in the US Army Reserves for a period of 6 years on 19 April 1980. On 9 July 1980, she was discharged from the Army Reserves for immediate enlistment in the Regular Army for a period or 3 years. She completed 2 years, 8 months and 28 days of creditable active service. Also 2 months and 30 days of inactive service. A copy of her DD Form 214 for this period of service is not available for review with this case. b. She executed a 3 year reenlistment in the RA on 7 April 1983. c. On 1 February 1985, she was honorably discharged under the provisions of Army Regulation 635-200(Personnel Separations – Enlisted Personnel), Chapter 13 for unsatisfactory performance. Her DD Form 214 shows her total prior active service of 2 years, 8 months and 28 days and her net active service this period of 1 year, 9 months and 25 days. 5. The DD Form 214 is a summary of a Soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge. Prior to September 1979, a separate DD Form 214 was issued for each period of reenlistment. Consolidation of two or more DD Forms 214 was not authorized at the time of his service. The applicant’s retirement DD Form 214 correctly reflects his record of service and contains no errors. 6. Army Regulation 635-5 (Separation Documents) established the standardized policy for preparing and distributing the DD 214. The purpose of the separation document is to provide the individual with documentary evidence of his or her military service. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found the relief was warranted. The applicant’s contentions were carefully considered. The Board agreed her DD Form 214 should show her entire continues period of active service as she was not issued a separation document for the immediate reenlistment. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending her DD Form 214 for the period ending 1 February 1985 by: a. block 12a – showing the entry “80 04 19” b. block 12c – showing the entry “04 09 13” c. block 12d – showing the entry “00 00 00” d. block 18 – add “IMMEDIATE REENLISTMENTS THIS PERIOD 19800419- 19830406; 19830407-19850201”; and “MEMBER HAS COMPLETED FIRST FULL TERM OF SERVICE.” I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2.
