IN THE CASE OF: BOARD DATE: 6 March 2020 DOCKET NUMBER: AR20180004280 APPLICANT REQUESTS: correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his rank as first sergeant (1SG). APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DD Form 214, ending 31 July 2017 FACTS: 1. The board will only address the applicant's request as it pertains to his DD Form 214. The applicant's retirement orders will be addressed through an administrative correction. 2. The applicant states he served as a 1SG and was awarded the 1SG skill qualification identifier (SQI) of "M." Therefore, his DD Form 214 should reflect the highest grade he held. 3. On 20 June 1997, the applicant enlisted in the Regular Army. 4. He was promoted to master sergeant (MSG)/E-8 on 1 August 2013. 5. Headquarters, U. S. Army Garrison (USAG), Fort McCoy, WI, published Permanent Orders 310-002, dated 6 November 2013, awarding the applicant the SQI of M based on his successful completion of 180 consecutive days in a 1SG position. 6. His DA Form 2166-8 (Noncommissioned Officer Evaluation Report) shows he served as a 1SG from for the period 1 May 2013 through 30 April 2014. 7. He completed his assignment as 1SG and he was reassigned as a Senior Human Resources Sergeant (MSG), in Yongsan, Korea. His Enlisted Record Brief shows he served in this position from 20 June 2016 until his retirement. 8. On 22 February 2017, the U. S. Army Installation Management Command, Pacific Region, USAG-Yongsan Transition Center, Korea, published Orders 053-0005, which placed the applicant on the Retired List, effective 31 July 2017, in the grade of MSG. 9. As directed above, the applicant retired on 31 July 2017. His DD Form 214 lists his rank as MSG. 10. Army Regulation 635-8 (Separation Documents) states to that the DD Form 214 will reflect the grade and rank held at the time of separation. BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents and evidence in the records. The Board considered the applicant’s statement, his record of service his assignment as a First Sergeant and his final assignment as a Senior Human Resources Sergeant (MSG). The Board considered the policy for completion of item 4 on separation documents. The Board found that the applicant’s DD Form 214 correctly reflects his rank at the time of retirement and that his Retired List Grade (1SG) is annotated in item 18 (Remarks). The Board concurs with the correction to the rank shown on his retirement orders as stated in the Administrative Note(s) below. Based on a preponderance of evidence, the Board determined that the rank reflected in item 4a. of his DD Form 214 was not in error or unjust. 2. After reviewing the application and all supporting documents, the Board found that partial relief was warranted. ? Army Installation Management Command, Pacific Region, USAG-Yongsan Transition Center, Korea, on 22 February 2017 as shown in the Administrative Note(s) that follow. 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to changing the rank shown in item 4a. of the DD Form 214 for the period ending 31 July 2017. Army Regulation (AR) 635-200 (Active Duty Enlisted Administrative Separations, paragraph 12-17 (Grade Title on Retired List of Former First Sergeants), states that noncommissioned officers holding the rank of MSG at retirement, whose records show successful service as a 1SG, will be placed on the Retired List in the grade title (rank) of 1SG. 2. AR 635-8 (Separation Documents) prescribes the separation documents that must be prepared for Soldiers on retirement, discharge, or release from active duty service or control of the active Army.
