ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 25 September 2019 DOCKET NUMBER: AR20180005196 APPLICANT REQUESTS: a change to the military occupational specialty (MOS) shown on his DD Form 214 (Certificate of Release or Discharge from Active Duty) from 11B (Infantryman) to 95B (Military Police). APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DA Form 2-1 (Personnel Qualification Record – Part II) * DD Form 214, period ending 6 May 1991 FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states he attended the Military Police Academy at Fort McClellan, AL. He worked as a Military Police until he entered the Correctional Course of Law Enforcement. He states, because he served in the U.S. Army as a Military Police, he should be granted that recognition. 3. A review of the applicant's service records shows: a. He enlisted in the Regular Army on 1 August 1978 and had continuous honorable service through 9 February 1988. b. He completed 8 weeks of training at the U.S. Army Military Police School (USAMPS), Fort McClellan, AL, and was awarded MOS 95B (Military Police) on or about November 1978. c. DA Form 2-1, Item 35, shows, in part, he served 9 years and 6 months in the MOS 95B from 24 November 1978 to 30 May 1988. It further shows in part, in * Item 17 (Civilian Education and Military Schools), he completed an 8-week Law Enforcement Course and was awarded the MOS 95B in 1978 and a 4- week Corrections Non-Commissioned Officer Course and was awarded the MOS 95C (Corrections NCO) in 1988, both at the U.S. Army Military Police School (USAMPS), Fort McClellan, AL * Item 35 (Record of Assignments), he in duty MOS (DMOS) 95B from 24 November 1978 to 29 May 1988 and DMOS 95C from 1 June 1988 to 6 May 1991 d. The applicant attained the rank of staff sergeant (SSG)/E-6 on 1 July 1989 and attained MOS 95B3O. e. He completed 4 weeks of training at USAMPS and was awarded MOS 95C (Corrections NCO) on or about May 1988. f. The applicant’s DA Form 2-1, Item 35, shows, in part, he served approximately 2 years and 11 months in the MOS of 95C from 1 June 1988 to 6 May 1991. g. On 6 December 1990, the applicant was reduced in rank/grade from SSG/E-6 to sergeant (SGT)/E-5, thereby changing his primary MOSC to 95C2O. h. He was discharged from active duty under honorable (general) conditions on 6 May 1991. His DD Form 214 shows in: * Block 11 (Primary Specialty), “11B2O INFANTRYMAN, 00 YEARS, 00 MONTHS//NOTHING FOLLOWS” * Block 14 (Military Education), “MILITARY POLICE CRS 8 WEEKS (1978) and CORRECTIONS NCO CRS 4 WEEKS (1988)” 4. By regulation (AR 635-5), the DD Form 214 is a synopsis of the Soldier’s most recent period of continuous active duty. The DD Form 214 is a summary of the Soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The instructions for completing the DD Form 214 stated: a. Block 11, Primary Specialty. Enter the titles of all MOSs awarded and held for at least 1 year during the current period of service and include for each MOS the number of years and months held. b. For an enlisted Soldier, specify the first five characters of the MOS code (MOSC), which includes three characters of the MOS, the fourth character of skill and grade level in the MOS, and the fifth character of a special qualification identifier, if applicable. Enter “O” when not applicable. A single additional skill identifier may be listed immediately following the five-character MOSC. BOARD DISCUSSION: After reviewing the application and all evidence, the Board found relief was warranted. The applicant’s contentions were carefully considered. Evidence of record shows he served in MOSs 95B and 95C. His record is absent evidence showing MOS 11B was awarded at any time. The Board agreed to amend his DD Form 214 showing the correct primary MOSs. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending block 11 of his DD Form 214 for the period ending 6 May 1991 by deleting reference to MOS 11B and adding the following: a. 95B, Military Policeman, 9 Years, 7 Months; and b. 95C, Corrections NCO, 2 Years, 11 months I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. Administrative Notes: Not applicable. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), then in effect, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for preparation of the DD Form 214. The DD Form 214 is a synopsis of the Soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharges discovered as a result of a physical examination. The instructions for completing the DD Form 214 stated: a. Block 11, Primary Specialty. Enter the titles of all MOSs awarded and held for at least 1 year during the current period of service and include for each MOS the number of years and months held. b. For an enlisted Soldier, specify the first five characters of the MOS code (MOSC), which includes three characters of the MOS, the fourth character of skill and grade level in the MOS, and the fifth character of a special qualification identifier, if applicable. Enter “O” when not applicable.
