ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 17 October 2019 DOCKET NUMBER: AR20180005648 APPLICANT REQUESTS: his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) be corrected to properly reflect his foreign duty location of Turkey. APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: DD Form 149 (Application for Correction of Military Record). FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states the location of his duty from 3 November 1962 to 1 April 1964 is incorrect. He was assigned to TUSLOG (the United States Logistics Group), Detachment 27, in Ankara, Turkey under the National Security Agency. His service was classified at the time and he was unable to correct it. 3. A review of the applicant’s service record shows: a. He enlisted in the Regular Army on 10 April 1962. b. His DA Form 24 (Service Record) shows in Section 5 (Service Outside of Continental United States), he departed for Ankara, Turkey on 3 November 1962 and returned to New York on 1 April 1964. c. He was honorably released from active duty on 9 April 1965. His DD Form 214 shows he completed 3 years of active service. It also shows in Block 24c. (Foreign and/or Sea Service) he was in U.S. Army Europe (USAREUR) for 2 years and 4 months. 4. By regulation, the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. For foreign service, enter the total foreign service performed outside continental United States during the period covered by the DD Form 214 and the major theater/overseas command. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was not warranted. The Board found that units serving in Turkey are part of U.S. Army Europe. The DD Form 214 lists the major overseas command. Based upon the documentary evidence provided by the applicant and found within the military service record, the Board concluded that the appliant’s DD Form 214 is correct. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents) states the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge.
