The applicant states, the period of her eligibility for HPO IP should have been effective 3 months after her graduation from her residency which was 28 August 2017. 2. The applicant's service record contains the following documents for the Board's consideration: a. A DA Form 71 (Oath of Office - Military Personnel), which shows she was appointed as a Reserve officer in the grade of Second Lieutenant (2LT)/ O-1 and took the oath of office on 21 July 2010. b. A Board of Medicine Certificate, which shows she was licensed to practice medicine and surgery. The issue date was 16 July 2015 and the expiration date was 30 September 2018. c. A memorandum for the Surgeon General, Subject: Request for HPO IP, which shows: * her specialty was Internal Medicine - Internist * the period of continuous active duty would be effective 1 January 2017 * she would receive $8,000 a year prorated monthly * she and the approval authority signed the form on 27 January 2017 d. A certificate showing she completed the ATLS Course for Doctors. The certificate was issued on 16 April 2017 and expires on 16 April 2021. e. A letter from the American Board of Internal Medicine, dated 3 October 2017, which shows the applicant passed the 2017 Internal Medicine Certification Examination. f. A memorandum for the Surgeon General, Subject: Request for HPO IP, which shows: * her specialty was Internal Medicine - Internist * the period of continued active duty was effective 1 January 2018 * she would get IP at the rate of $43,000 a year paid on a monthly basis * she and the approval authority signed the form on 30 January 2018 3. The applicant provides the following documents for the Board's consideration: a. A letter from National Capital Consortium Internal Medicine Residency Program, dated 28 August 2017, which states the applicant successfully completed Internal Medicine Residency from 1 July 2014 through 28 August 2017. b. A memorandum for the Surgeon General requesting HPO IP effective 1 January 2018, which was present in her service record. c. Her April 2018 LES, which shows she had save pay in the amount of $12,833.34. d. Email correspondence between the applicant and a Human Resources (HR) Assistant, that shows: * on 30 April 2018, the HR assistant said he was working with the Office of the Surgeon General (OTSG) on how to fix her contract it should have been effective 28 November 2017 instead of 1 January 2018 * on 1 May 2018, the HR assistant said the contract was signed with the wrong effective date by two months * on 1 May 2018, the applicant requested an explanation of the error in her contract * on 1 May 2018, the HR assistant was informed by the OTSG informing the applicant she would have to contact the Board to correct the 2 months error 4. DoDI 7000.14-R (Financial Management Regulation) Volume 7A, Chapter 5 (HPO Special IP) states the effective date of the IP agreement will be calculated from the date the member completes the qualifying training plus 3 months. BOARD DISCUSSION: The Board carefully considered the complete evidentiary record, including the applicant’s statement and supporting documents and found sufficient evidence to grant relief. The Board agreed that the applicant met all the criteria for award of HPOIP beginning on 28 November 2017. Therefore, the board determined that full relief was warranted. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: 1. showing that the applicant timely executed and submitted her HPOIP request contract effective 28 November 2017, that her Personnel Office duly processed her request in a timely manner, and 2. paying her any HPOIP due, subject to review by Office of the Surgeon General to determine period of eligibility and amount due.
