The applicant states he was due an $8,000 enlistment bonus, and it was omitted on his DA Form 3286, Annex B contract. He is requesting the bonus be paid. 2. A review of the applicant’s official record shows: a. On 14 December 2016, he enlisted in the US Army Reserve (USAR) and joined the delayed entry program. He was to enlist in the Regular Army on 17 January 2017. b. On 3 January 2017, he signed his DA Form 3286, Annex A which shows: (1) He enlisted for the Program 9A – United States Army Training Enlistment Program (UNCM), Request Option 03, and Program 9C – United States Army Incentive Enlistment Program, Request Option 271, a US Army Seasonal Bonus (Mid-Priority Seat) and cash bonus of $8,000.00. (2) His Military Occupational Specialty was 91C Utilities Equipment Repair. (3) He understood that the bonus amount is a combination of the bonuses listed in paragraph 2 of this annex. Total amount of all combined bonuses is $8000 as authorized by Headquarters, Department of the Army (HQDA) incentives message effective21 Aug 2015. (4) He understood that this bonus amount cannot exceed $10,000 for a two year term of service, $20,000 for a three year term of service, $25,000 for a four year term of service, $30,000 for a five year term of service, and $40,000 for a six year term of service. Initial payment of his bonus will not exceed $10,000 upon completion of contracted MOS training and arrival at his first duty station. The remaining bonus amount will be paid in equal anniversary payments across the remainder of his enlistment contract. He understood if he fails to complete his initial term of service in the incentivized MOS in which he was contracted due to his own misconduct, performance or reasons other than the needs of the Department of the Army, resulting in failure to attain the bonus MOS, his bonus eligibility will be terminated and any unearned amount received will be subject to recoupment. He further understands that his eligibility to receive Non MOS related incentives such as HIGRAD bonus, 8 year MSO (option 800) bonus or (SENIOR DELAYED SHIP BONUS (Incentive 502)), remains intact providing he remains otherwise eligible and complete my first term of Army contracted service. (5) He signed the form stating he read and understood the statements above and that these statements are intended to constitute ALL promises and guarantees whatsoever concerning his enlistment. No other (verbal or otherwise) promise or representation not annexed to his enlistment contract is valid or will be honored. c. On 3 January 2017, his DD Form 1966 (Record of Military Processing - Armed Forces of the United States) shows in Block #32, he enlisted for Option 271, Military Occupational Specialty (MOS) 91C1O00YY (Utilities Equipment Repairer), term of Service – 3 years 29 weeks and Uncommitted First Assignment (UNCM). d. On 24 January 2017, he signed his DA Form 3286, Annex B which shows: (1) He enlisted for the Program 9A – United States Army Training Enlistment Program (UNCM), Request Option 03 only. It does not reflect his enlistment bonus. (2) His Military Occupational Specialty was 91C Utilities Equipment Repair. (3) He signed the form stating he read and understood the statements above and that these statements are intended to constitute ALL promises and guarantees whatsoever concerning his enlistment. No other (verbal or otherwise) promise or representation not annexed to his enlistment contract is valid or will be honored. e. On 1 June 2017, (Orders 152-00531) issued by US Army Combined Arms Support Command (CASCOM) awarded the applicant his MOS of 91C. 3. The applicant provides: a. His DA Form 3286 Annex A (Statement for Enlistment United States Army Enlistment Program U. S. Army Delayed Enlistment Program), see 2b. above. b. His DA Form 3286 Annex B (Statement for Enlistment United States Army Enlistment Program U. S. Army Enlistment Program), see 2d. above. c. On 1 June 2017, (Orders 152-00641) issued by US Army Combined Arms Support Command (CASCOM) assigned the applicant to Fort Bliss, Texas. 4. See REFERENCES below. BOARD DISCUSSION: After reviewing the application and all supporting evidence, the Board found that full relief was warranted. The Board found that the applicant was unjustly denied his a US Army Seasonal Bonus (Mid-Priority Seat) and cash bonus of $8,000.00. The applicant completed all the required paperwork, which was validated by his chain of command on 3 January 2017, and was promised a bonus of $8,000 for his MOS on a delayed enlistment contract. Then, 16 days later, upon enlistment, the bonus was absent from his new contract. The Board found this to be an injustice as the original contract should have been honored. The Board agreed that the applicant did everything he was supposed to do and deserves to retain the $8000.00 Seasonal Bonus. ? As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing the applicant is entitled to receive US Army Seasonal Bonus (Mid-Priority Seat) and cash bonus of $8,000.00. 2. DFAS paying him appropriate Army Seasonal Bonus (Mid-Priority Seat) and cash bonus of $8,000.00 in accordance with the aforementioned correction minus any payments already issued.
