ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS BOARD DATE: 17 September 2019 DOCKET NUMBER: AR20180008523 APPLICANT REQUESTS: correction of item 3 (Social Security Number (SSN)) of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge), for the period ending 16 June 1977, from “XXX-XX-XXX” to a completely different SSN (XXX-XX-XXX). APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * Photocopy of his SSN card and birth certificate * Discharge Orders and Certificate * DD Form 214 (Report of Separation From Active Duty) FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his SSN is incorrect on his DD Form 214 and would like it changed. He provides: * Social security card dated 2 February 2012 and birth certificate dated 9 September 2014; his social security card shows his SSN as "XXX-XX-XXXX" * Discharge orders dated 14 April 1977, shows his SSN as “XXX-XX-” * DD Form 214 for period ending 16 June 1977, shows his SSN as “XXX-XX- XXXX” 3. A review of his service records shows: a. The applicant enlisted in to the Regular Army on 17 June 1974. b. The applicant was honorably released from active duty on 16 June 1977. Item 3 (SSN) of his DD Form 214 shows his SSN as "XXX-XX-XXXX." c. His service record reveals he served under the contested SSN throughout his entire period of active duty service. 4. By regulation 635-5 (Separation Documents), dated 23 May 1972, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It stated to transcribe the SSN at the time of separation from applicable documents in item 3. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was not warranted. Board members believed that his record consistently showed the SSN that ends with XXXX. He is asking for a completely different SSN but does not show he used this SSN during his military service or what caused the discrepancy. The social security card he provides was issued in 2012 and has a slightly different name. For that reason, the Board concluded that no error or injustice was present which would warrant making a change to the applicant’s record. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separations Documents), dated 23 May 1972, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge.
