The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his SSN is incorrect on his DD Form 214 for ending period 3 February 1978 and requests a correction to show the SSN from the documents he provides. The applicant states that every time he had to recite his SSN in Oklahoma, he was told his SSN was incorrect based on the SSN on his DD Form 214. The applicant states he kept requesting the United States Army to make a correction to show his correct SSN; however, they did not make the correction. 3. The applicant's complete military records are not available for review. A complete and thorough search for his military records was conducted; however, his records could not be located. This case is being considered based on the documents provided by the applicant. 4. The applicant’s DD Form 214 for ending period 3 February 1978 shows that he served in the Army National Guard for the period covered by the DD Form 214. The DD Form 214 also shows lists SSN A. 5. The applicant provided a copy of his social security card and Driver’s License, which lists his SSN as SSN B. 6. Army Regulation (AR) 635-5 (Separation Documents), then in effect, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It stated to transcribe the SSN at the time of separation from applicable documents in Item 3 (SSN) of the DD Form 214. BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents and evidence in the records. The Board considered the applicant’s statement, the absence of a record of service, the SSN reflected on the applicant provided DD Form 214 and the evidence provided by the applicant. The Board found insufficient evidence that the SSN reflected in the applicant’s records did not represent the circumstances as they existed at the time of his service. Based on a preponderance of evidence, the Board determined that the SSN on the DD Form 214 shown for the applicant upon separation was not in error or unjust. 2. The applicant is advised that a copy of this decisional document will be filed in his official military personnel file. This should serve to clarify any questions or confusion about the difference in the SSN recorded in his military records and the SSN on his Social Security Card. 3. After reviewing the application and all supporting documents, the Board found that relief was not warranted. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. AR 635-5 (Separations Documents), then in effect, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge.
