The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20150002958 on 22 September 2015. 3. The applicant provides at letter from the Pennsylvania Army National Guard, Command Historian who states: a. Their records had him listed as serving with Battery B, 108th Field Artillery, 28th Division Artillery (DIVARTY), 28th Infantry Division (ID). Their records indicate that he was assigned to the Geopping Area Command. This command included the following units: Headquarters and Headquarters Company (HHC), 28th ID; Headquarters and Headquarters Battalion (HHB), 28th DIVARTY; 108th Field Artillery (FA); 899th Antiaircraft Automatic Weapons Battalion; 28th Signal Company; 28th Replacement Company; 28th Quartermaster Company; 28th MP Company; 28th CIC Detachment and the 28th Division Band. Please note that the records and logs at the Pennsylvania National Guard Military Museum indicated that while he were stationed under Geopping Area Command, the 108th FA and the 899th AAA were physically located at Schwabisch Gmund and Nellingen. b The applicant also provides a Europe Pictorial Review Battery B, 108th covering 1951-1952. 4. The majority of the applicants military records are not available for review. A fire destroyed approximately 18 million service members records at the National Personnel Records Center (NPRC) in 1973. The NPRC believes that the applicants records were lost or destroyed in that fire. However, there were sufficient documents remaining in a reconstructed record to conduct a fair and impartial review of this case. 5.. His DD Form 214 (Report of Separation from the Armed Forces of the United States) shows he was inducted into the Army of the United States and entered active duty on 26 November 1951. 6. On 5 November 1953, he was honorably released from active duty. He completed 1 year, 11 months, and 10 days of net active service this period. He also completed 1 year, 5 months, and 10 days of Foreign Service. His most significant duty assignment was B Battery, 108th FAB. His DD Form 214 does not show he was awarded the Army of Occupation Medal. 7. By regulation, an applicant is not entitled to a hearing before the ABCMR. Hearings may be authorized by a panel of the ABCMR or by the Director of the ABCMR. 8. By regulation, Army Regulation AR 600-8-22 (Military Awards) in effect at the time, stated the Army of Occupation Medal with Germany Clasp is awarded for qualifying service between 9 May 1945 and 5 May 1955. Service between 9 May 1945 and 8 November 1945 will be counted only if the European-African-Middle Eastern Campaign Medal was awarded for service before 9 May 1945. 9. Department of the Army (DA) Pamphlet 672-1 (Unit Citation and Campaign Participation Credit Register) lists campaign participation credit, assault landing credit, unit citation emblems, and occupation duty credit. This document shows the 108th FAB received occupation credit for the period 2 May - 5 July 1945 for service in Germany. 10. By regulation (AR 15-185), applicants do not have a right to a hearing before the ABCMR. The Director or the ABCMR may grant a formal hearing whenever justice requires. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined the evidence of record was sufficient to render a fair and equitable decision. As a result, a personal appearance hearing is not necessary to serve the interest of equity and justice in this case. Additionally, the Board determined relief was warranted. The applicants contentions were carefully considered. Based upon the preponderance of the evidence, the Board determined there is sufficient evidence to grant relief and amend the previous Boards decision. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding the Army Occupation Medal with Germany Clasp to his DD Form 214 for the period ending 5 November 1953. Title10, USC, section1552(b), provides that applications for correction of military records must be filed within threeyears after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation AR 600-8-22 (Military Awards), in effect at the time, prescribes Army policy, criteria, and administrative instructions for individual military decorations. a. Paragraph 5-8, the Army of Occupation Medal was established by War Department General Orders 32, 1946. It is awarded for service for 30 consecutive days at a normal post of duty (as contrasted to inspector, visitor, courier, escort, passenger, temporary duty (TDY), or detached service) while assigned to any of the following: Army of Occupation of Germany (exclusive of Berlin) between 9 May 1945 and 5 May 1955. Service between 9 May and 8 November 1945 will be counted only if the European-African-Middle Eastern Campaign Medal was awarded for service before 9 May 1945. b. Subparagraph 5-8b (1), the Army of Occupation Medal Clasp. Soldiers who served in the European Theater during the occupation of Europe will wear the clasp inscribed "Germany." Soldiers who served in the Far East Theater during the occupation of the Far East will wear the Clasp inscribed "Japan." Clasps bearing other inscriptions are not authorized. 3. AR 15-185 (ABCMR) prescribes the policies and procedures for correction of military records by the Secretary of the Army, acting through the ABCMR. The ABCMR begins its consideration of each case with the presumption of administrative regularity, which is that what the Army did was correct. a. The ABCMR is not an investigative body and decides cases based on the evidence that is presented in the military records provided and the independent evidence submitted with the application. The applicant has the burden of proving an error or injustice by a preponderance of the evidence. b. The ABCMR may, in its discretion, hold a hearing or request additional evidence or opinions. Additionally, it states in paragraph 2-11 that applicants do not have a right to a hearing before the ABCMR.
