The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states that he would like to change item 11 (Primary Specialty) from 11C40 P5 Indirect Fire Infantryman-0 years, 0 months and 71L30 Administrative SP - 12 years, 8 months to 11C40 PS QB Indirect Fire- Infantryman - 23 years, 4 months and 7IL30 Administrative SP - 0 YRS - 8 months. He further states that he spent his military career as military occupational specialty (MOS) 11C indirect Fire Infantryman. He added the identifier after he qualified as a Spanish translator. He spent a total of 23 years and 4 months in his primary MOS of 11C. He did serve on temporary duty as MOS 71L30 to assist the downsizing of the 543rd area support group (ASG) in Bremerhaven Germany for a total of 8 months from 13 March 1992, to 12 November 1992 at which time he returned to work in his primary MOS 11C. He further states that he tried to apply for a work as a civilian contractor based on his military career, Infantry background, and MOS qualifications but was denied employment due to the erroneous DD Form 214, Item 11 description of his Military MOS. 3. The applicant provides a copy of his DD Form 214 that shows in item 11 (Primary Specialty) from 11C40 P5 Indirect Fire Infantryman-0 years, 0 months and 71L30 Administrative SP - 12 years, 8 months. A copy of his ERB, dated 30 October 2002, that shows on line 1 (Duty MOS) as 11C. 4. A review of the applicant’s record shows the following: a. He enlisted in the in the Regular Army (RA) on 2 October 1980. He reenlisted on 20 July 1983, 28 April 1986, 7 November 1991, 31 August 1995, and 17 May 1999. b. His DA Form 2-1 (Personnel Qualification Record) shows in block 35 (Record of Assignment) duty MOS as 11C effective from 10 October 1980 to 12 March 1992, 71L30 effective13 March 92 and 11C from 1 May 1993 to 13 August 1999. c. His ERB, dated 30 October 2002, shows on line 1 (Duty MOS) 11C40 effective 13 August 1999. d. Orders 119-0106, dated 28 April 2004, releases the applicant from active duty and places him on the retired list effective 31 October 2004. d. He was retired from active duty on 31 October 2004 with an honorable character of service. His DD Form 214 shows in item 11 (Primary Specialty) from 11C40 P5 Indirect Fire Infantryman-0 years, 0 months and 71L30 Administrative SP - 12 years, 8 months. He completed 24 years and 29 days of active duty service. 5. AR 635-8 (Personnel Separations – Separation Processing and Documents) paragraph 5-5 (Policy concerning the DD Form 214) states enter the titles of all MOS or areas of concentration awarded and held for at least one year during the current period of service and include for each MOS the number of years and months held. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board determined that relief was warranted. Based upon the information outlined on the applicant’s DA Form 2-1, assignment history, the Board determined that the information in Block 11 of the applicant’s DD Form 214 was incorrected and warranted correction. ? As a result, the Board recommends that all Department of Army records of the individual concerned be corrected by amending the applicant’s DD Form 214 by changing the entry in Primary Specialty (Item 11) to read: * 11C40P5 INDIRECT FIRE INFANTRYMAN—22 YRS 11 MOS * 71L30 ADMINISTRATIVE SP – 1 YR 2 MOS I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. ? REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2.
