The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states she would like item 12a. (Date Entered Active Duty this Period) to reflect 22 September 2007 and item 12c (Net Active Service this Period) changed to reflect 2 years, 6 months and 10 days. 3. The applicant provides: a. A copy of her DD Form 214 for the period covering 11 September 2008 through 20 March 2009. b. Orders: 7094008, initial active duty for training (IADT) dated 4 April 2007. 4. A review of the applicant’s service record shows: a. She enlisted in the U.S. Army Reserve (USAR) on 4 April 2007. b. She was ordered to IADT for 52 weeks or completion of basic and 68W MOS training on 11 September 2007. c. She was released from active duty training on 20 March 2009. Her DD Form 214 shows she completed “1 year, 6 months and 10 days” of net active service and 5 months and 7 days of prior inactive service. d. According to her IADT orders which were stamped item 12a should read “11 September 2007” and item 12c should read “2 years, 6 months and 10 days”. 5. Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers upon retirement, discharge, or release from active duty service or control of the Active Army. a. The general instructions stated all available records would be used as a basis for preparation of the DD Form 214. b. The DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found the relief was warranted. Based upon the information reflected on the applicant’s order to active duty (specifically, the dates reflected on the stamped portion of the order), the Board concluded that the current information reflected on the DD Form 214 of the applicant was entered in error or warranted correction. As a result, the Board recommends that all Department of Army records of the individual concerned be corrected by amending the applicant’s DD Form 214 by: * changing the Date Entered this Period (Item 12a) to read, “2007 09 11” * changing the Net Active Service this Period (Item 12c) to read, “0002 06 10” I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers upon retirement, discharge, or release from active duty service or control of the Active Army. It established standardized policy for preparing and distributing the DD Form 214. The general instructions stated all available records would be used as a basis for preparation of the DD Form 214.
