ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 26 September 2019 DOCKET NUMBER: AR20180012439 APPLICANT REQUESTS: correction of his (Social Security Number (SSN)) on his DD Form 214 (Certificate of Release or Discharge from Active Duty), to show as "XXX-XX-####" instead of "XXX-XX-####." APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * Social Security Card * Standard Form (SF) 180 (Request Pertaining to Military Records) * Separation orders 77-8, dated 4 June 1986 * DD Form 214 (Certificate of Release or Discharge from Active Duty) FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states the social security number (SSN) XXX-XX-#### listed in his records is incorrect. He states his social security number is XXX-XX-####. He states when he joined the Army at seventeen years old, his mother mistakenly gave him his younger brother’s social security card. He states he reported this to the Department of Veterans Affairs in 1988 and was told the record would be corrected. 3. The applicant provides: a. A copy of his SSN card to show his SSN as "XXX-XX-####," however, the SSN card is illegible. b. Standard Form (SF) 180 (Request Pertaining to Military Records), shows the applicant requested his DD Form 214 (Certificate of Release or Discharge from Active Duty) with the SSN he states is not correct. He states that he has requested for it to be corrected. c. Separation orders number ####, showing the SSN the applicant states is incorrect on his record. d. DD Form 214 which according to the applicant also has the incorrect SSN. 4. A review of his service records shows: a. He enlisted in the Regular Army on 5 July 1983. b. His DD Form 214, shows he attended military occupational specialty (MOS) 91A10 (Medical Specialist) training for 10 weeks. c. His service records shows his SSN “XXX XX ####.” d. On 3 July 1986, he was honorably released from active duty and transferred to U.S. Army Reserve (USAR) Control Group (Reinforcement) to complete his remaining service obligation ending 8 March 1989. His DD Form 214 shows in item 3 (Social Security Number), SSN as "XXX-XX-####." e. His honorable discharge from the Ready Reserve also show’s his SSN as XXX-XX-####. f. The applicant applied to the Army Board for Correction of Military Records (ABCMR), for a correction of his DD Form 214 and the case was transferred to the U.S. Army Human Resources Command (AHRC) for action. g. HRC responded stating the Command is not authorized to grant the requested change to the applicant’s SSN as the DD Form 214 in question reflects the same SSN used throughout the applicant’s U.S. Army Service. 5. By regulation, 635-5, the DD Form 214 is a summary of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of all current active, prior active, and prior inactive duty service at the time of release from active duty, retirement, or discharge. The information entered thereon reflects the conditions as they existed at the time of separation. It stated for entries in item 3, transcribe the social security account number (SSAN) from DA Form 2-1 (Service Record) in the following manner “SSAN XXX-XX-####.” BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found relief was not warranted. Based upon the documentary evidence provided by the applicant and found within the military service record, the Board found that the SSN currently depicted on the applicant’s DD Form 214 is consistent with all SSN’s within the military service record of the applicant. The Board concluded that the applicant did not provide sufficient information or justification for the different SSN; therefore, the Board recommended deny the applicant’s request. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2.
