IN THE CASE OF: BOARD DATE: 27 February 2020 DOCKET NUMBER: AR20180012762 APPLICANT REQUESTS: His reenlistment contract be corrected to show his reenlistment bonus (REB) as $20,000.00 instead of $10,000.00 based on the current United States Army Reserve (USAR) Selected Reserve Incentive Program (SRIP) List. APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * letter from USAR Command * letter from Congressman Sensenbrenner FACTS: 1. The applicant states he reenlisted in the USAR on 9 December 2017, for a $10,000.00 bonus in military occupational specialty 12N (Horizontal Construction Engineer). He believes this is an injustice because he reenlisted before his first contract expired. When the bonus was increased he had not begun his new contract nor had he received any money. 2. The applicant reenlisted in the USAR on 9 December 2017; however, his bonus addendum is not available for review and the applicant did not provide it. 3. The applicant provides a letter from the USAR Command addressed to the applicant's congressman in response to the applicant's request. The letter states, in part, the applicant reenlisted in the USAR on 9 December 2017, for a 6-year term with a $10,000.00 bonus in MOS 12N. The applicant requests the REB be Increased to $20,000 based on the current USAR SRlP List. Public law requires the bonus amount be fixed upon acceptance of the written agreement. The applicant's written agreement was accepted on 9 December 2017; therefore, the USAR Command G-1 does not have the authority to increase the applicant's bonus amount. The applicant may apply to the Army Review Boards Agency (ARBA) to pursue any perceived injustice. 4. Change 3 to USAR Fiscal Year 2017 (FY17) SRIP Policy Guidance from 15 September 2017 until Publication of the FY18, prescribes standards for administering the USAR SRIP for FY 17. The policy offered a $10,000.00 REB for a 6- year term in MOS 12N. It states bonuses are subject to the availability of incentive funds, which may change without notice. Soldiers, who may be otherwise eligible for a bonus, will not receive the advertised bonus unless their incentive is assigned a valid bonus control number (BCN). 5. USAR FY18 SRIP Policy Guidance Change 1, effective 5 March 2018 through 30 September 2018, prescribes standards for administering the USAR SRIP for FY 18. This policy offered a $20,000.00 REB for a 6-year term in MOS12N. It states bonuses are subject to the availability if incentive funds, which may change without notice. Soldiers, who may be otherwise eligible for a bonus, will not receive the advertised bonus unless their incentive is assigned a valid bonus control number BCN. 6. Title 37, United States Code, section 331, provides that a person or member determined To be eligible for a bonus shall enter into written agreement with the Secretary concerned that specifies the amount of the bonus. BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents, evidence in the records, and regulatory requirements. The Board noted the facts presented above. The Board noted that the applicant signed a contract on 9 December 2017 for an REB of $10,000 for a 6-year term of service with in MOS 12N. By public law, the REB amount is fixed upon acceptance and signing of the written agreement on the date signed. The applicant is not eligible for a subsequent REB from FY18. Based on a preponderance of evidence, the Board determined that there was no error or injustice in the applicant’s REB amount of $10,000 accordingly as contracted. 2. After reviewing the application and all supporting documents, the Board found that relief is not warranted. ?
