Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20060016164 on 10 May 2007 and reconsidered by the ABCMR in Docket Number AR20080000788 on 17 April 2008. 2. The applicant has provided new evidence not previously considered that warrants consideration at this time. 3. The applicant states he served in Kosovo under Kosovo Force and he was awarded the Kosovo Campaign Medal, but it was never entered on his DD Form 214. 4. On 29 June 2001, the applicant enlisted in the Regular Army. 5. Records show he was assigned to Germany on 20 November 2001 and returned from overseas on 11 November 2005. 6. His records contain a certificate of achievement for service and support to Task Force Camp Able Sentry, Macedonia, from 15 March 2002 to 1 June 2002. 7. He provided copies of a memorandum from the 21st Theater Support Command, Unit 23203, dated 27 May 2002, that listed Soldiers approved to redeploy from Camp Bondsteel, Kosovo on 27 May 2002. This list shows his name and , a former Soldier previously assigned with him. 8. He also provided copies of the following documents from , a Soldier with whom he served: a. Kosovo Force identification card with an expiration date of November 2002, b. DD Form 214 that does not show award of the Kosovo Campaign Medal but does show her foreign service in Kosovo from 27 May 2002 through 1 June 2002, c. DD Form 215 that shows she was placed on the Temporary Disability Retired List, and d. an undated and unsigned statement in which she stated the applicant deployed to Kosovo with their platoon with the 529th Military Police Company. 9. On 27 March 2006, the applicant was honorably discharged. His DD Form 214 shows in: a. item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized): * Army Superior Unit Award * Army Good Conduct Medal * National Defense Service Medal * Global War on Terrorism Service Medal b. item 12f (Foreign Service) – no foreign service. 10. On 10 May 2007 and in ABCMR Record of Proceedings, Docket Number AR20060016164, the ABCMR denied the applicant's request for award of the Kosovo Campaign Medal. The Board determined that: a. Although he provided evidence to show he served in Kosovo, there was no evidence to show what operations he participated in. Since it could not be determined if he participated in one of the operations listed in the governing regulation as being eligible for award of the Kosovo Campaign Medal, there was insufficient evidence on which to base award of the Kosovo Campaign Medal. b. The evidence presented was sufficient to warrant a recommendation for partial relief and credited him with 2 years, 11 months, and 21 days of foreign service. The Board further recognized he was awarded the North Atlantic Treaty Organization (NATO) Medal for service with NATO on operations in relation to Kosovo during the period 12 April 2002 through 21 May 2002. 11. His records contain a DD Form 215, dated November 2007, showing he was credited with 2 years, 11 months, and 21 days of foreign service, the NATO Medal, Army Service Ribbon, and the Overseas Service Ribbon. 12. On 17 April 2008 and in ABCMR Record of Proceedings, Docket Number AR20080000788, the ABCMR reconsidered and denied his request for award of the Kosovo Campaign Medal. The Board determined found that although he provided a Kosovo Force Identification Card, it was insufficient evidence to show what operations he participated in. The applicant was advised such evidence might include a statement from a member of the applicant's chain of command at the time of his service in Kosovo verifying he participated in one of the qualifying operations. It could not be determined if the applicant participated in one of the operations listed in the governing regulation as being eligible for the Kosovo Campaign Medal, therefore there was insufficient evidence on which to base award of the Kosovo Campaign Medal. BOARD DISCUSSION: 1. After reviewing the application and all supporting documents, the Board found that relief is warranted. 2. The Board agreed that, although the record is silent on which qualifying operation the applicant was deployed in support of, his service in Macedonia from on or about 15 March 2002 to on or about 1 June 2002 would have been in direct support of either Operation Joint Guardian (11 June 1999 to 31 December 2013) or Task Force Falcon (11 June 1999 to 31 December 2013). The Board determined a preponderance of the evidence supports a decision to correct his record by adding the Kosovo Campaign Medal with one bronze service star. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding the Kosovo Campaign Medal with one bronze service star to his DD Form 214 for the period ending 27 March 2006. REFERENCES: Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. a. The Kosovo Campaign Medal is awarded to members of the Armed Forces of the United States who, after 24 March 1999, meet the following criteria: (1) Participated in or served in direct support of Kosovo Operation(s): Allied Force; Joint Guardian (11 June 1999 to 31 December 2013); Allied Harbour; Sustain Hope/Shining Hope; Noble Anvil; or Kosovo Task Force(s): Saber, Hunter, Hawk, or Falcon (11 June 1999 to 31 December 2013) within the Kosovo Air Campaign or Kosovo Defense Campaign areas of eligibility (AOE). (a) Kosovo Air Campaign – The Kosovo Air Campaign began on 24 March 1999 and ended on 10 June 1999. The AOE for the air campaign includes the total land area and airspace of Serbia (including Kosovo), Montenegro, Albania, Macedonia, Bosnia, Croatia, Hungary, Romania, Greece, Bulgaria, Italy, and Slovenia; and the waters and airspace of the Adriatic and Ionian Sea north of the 39th north latitude. (b) Kosovo Defense Campaign – The Kosovo Defense Campaign began on 11 June 1999 to 31 December 2013. The AOE for the defense campaign includes the total land area and airspace of Serbia (including Kosovo), Montenegro, Albania, Macedonia, and the waters and airspace of the Adriatic Seas within 12 nautical miles of the Montenegro, Albania, and Croatia coastlines south of 42 degrees and 52 minutes north latitude. b. Servicemembers must be bona fide members of a unit participating in or be engaged in direct support of the operation for 30 consecutive days in the AOE or for 60 nonconsecutive days provided this support involves entering the operations AOE or meets one or more of the following criteria: (1) Be engaged in actual combat, or duty that is equally as hazardous as combat duty, during the operation with armed opposition, regardless of time in the AOE. (2) While participating in the operation, regardless of time, is wounded or injured and requires medical evacuation from the AOE. (3) While participating as a regularly assigned air crewmember flying sorties into, out of, within, or over the AOE in direct support of the military operations. c. One bronze service star will be worn for participation in each campaign (Kosovo Air Campaign and Kosovo Defense Campaign). d. Qualification for a second bronze service star requires meeting the criteria for both campaigns.
