ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 13 September 2019 DOCKET NUMBER: AR20180013403 APPLICANT REQUESTS: correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge), for the period ending 19 July 1967 to show his correct social security number (SSN) as "XXX-XX-XXXX" instead of "XXX-XX-XXXX." The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his DD Form 214 contains the wrong social security number; however, his discharge certificate has the correct number. 3. The applicant provides: a. DD Form 214, which shows in Item 3, the wrong typed entry "XXX-XX-XXXX". b. An Honorable Discharge Certificate dated 10 October 1972 shows the SSN XXX- XX-XXXX. c. A social security card, which shows his SSN as "XXX-XX-XXXX." 4. A review of the applicant’s service record shows: a. He was inducted into the Army of the United States on 11 October 1965. b. He was honorably released from active duty on 19 July 1967 and transferred to the United States Army Reserve (USAR) Control Group (Reinforcement). The DD Form 214 he was issued shows in Item 3, the entry "XXX-XX-XXXX". c. Letter Orders Number 09-1213456, dated 30 September 1971, honorably discharged the applicant from the USAR and shows his social security number as XXX- XX-XXXX. 5. Army Regulation 635-5 (Separations Documents), in effect at the time, prescribed guidance for separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. a. Item 2, enter the individual's service number and authorized prefix. b. Item 3, transcribe the SSN number from the appropriate documents. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found the relief was warranted. The applicant’s contentions were carefully considered. His record was not available for the Board to review. His active duty separation document shows a different SSN than what is listed on his social security card. However, his USAR separation documents show the same SSN as listed on his social security card. The Board agreed to grant relief noting the SSN on his DD Form 214 may have been typed in error as there is no record to dispute this conclusion. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 for the period ending 19 July 1967 by showing the social security number listed on his social security card. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2.
