The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, she did not notice her middle name was spelled incorrectly on her DD Form 214 until she requested a duplicate copy. 3. The Board will not consider the portion of the applicant's request pertaining to her date of entry nor her military education, as these items will be addressed through an administrative correction. The Board will only consider the portion of the applicant's request pertaining to the applicant's name and date of birth. 4. All of the documents in the applicant's record, which include her middle name and date of birth, list her middle name as "" and her date of birth as . These records include but not limited to the following document(s): * DD Form 369 (Police Record Check, dated 19 November 1981 * DD Form 1966 (Application for Enlistment – Armed Forces of the United States) * DD Form 4 (Enlistment/Reenlistment Documents – Armed Forces of the United States) * DA Form 2A (Personnel Qualification Record), dated 9 May 1986 * DD Form 214 5. None of the records in her military record list the name of date of birth she now requests. 6. On 3 November 1986, the applicant was released from active duty. 7. The applicant provides a certificate of birth, which shows the name and date of birth she currently requests. 8. Army Regulation 635-5 (Separation Documents), in effect at the time, established the standardized policy for preparing and distributing the DD Form 214. The purpose of the separation document is to provide the individual with documentary evidence of his or her military service at the time of release from active duty, retirement, or discharge. BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents end evidence in the records. The Board considered the applicant’s statement, the available service records, to include those with her signature, all showing the name and date of birth she contests, the Certificate of Birth she provided with an issue date of 1998 and her separation document. The Board determined, by a preponderance of evidence, that the DD Form 214 in the record reflected the conditions and circumstances as they existed at the time of service and found no error or injustice. The Board advises the applicant that a copy of this decision will be placed in her official records to clarify the difference between the middle name and DOB shown in her records and the DOB and middle name she uses today. The Board concurs with the corrections stated in the Administrative Note(s) below. 2. After reviewing the application and all supporting documents, the Board found that relief was not warranted.? REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), in effect at the time, established the standardized policy for preparing and distributing the DD Form 214. The purpose of the separation document is to provide the individual with documentary evidence of his or her military service at the time of release from active duty, retirement, or discharge. It is important that information entered on the form be complete and accurate and reflects the conditions as they existed at the time of separation.
