ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 29 July 2019 DOCKET NUMBER: AR20180014397 APPLICANT REQUESTS: correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to - * show his last name as show his Military Occupational Specialty (MOS) as 11B1O * add service in Korea * add the Imjin Scout Certificate * add the Armed Forces Expeditionary Medal (AFEM) * change place of birth to APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DD Form 214, ending 3 November 1969 FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant requests correction of his DD Form 214 to correct the spelling of his last name, place of birth, and that his foreign service in Korea and the AFEM be added to this document. The applicant’s aforementioned requests will be addressed through an administrative correction and does not require action by this Board. The Board will consider the applicant's request to have 11B1O annotated as his primary MOS and entry to show the Imjin Scout Certificate on his DD Form 214. 3. The applicant states that his unit in Germany did not have infantrymen positions; therefore, he was converted to a Heavy Wheel Driver. 4. On 25 November 1966, the applicant enlisted into the Regular Army and obtained the infantrymen MOS (11B). 5. The applicant served in Korea from 3 June 1967 to 2 July 1968. 6. His record does not contain any evidence that shows he was awarded the Imjin Scout Certificate. 7. On 26 August 1968, the applicant was stationed in Germany. 8. His DA Form 20 (Enlisted Qualification Record) shows MOS 11B1O was his secondary MOS (SMOS) and that he was awarded the primary MOS (PMOS) of 64B2O (Heavy Wheel Driver) on 19 November 1968. 9. Special Orders 198, issued by Headquarters, Kaiserslautern Army Depot, on 20 October 1969 show the applicant's PMOS as 64B2O and SMOS as 11B1O. 10. On 3 November 1969, the applicant was honorably discharged. His DD Form 214 contains the following entries: a. item 22c (Foreign and/or Sea Service) – "See 30" and 2 years, 3 months, and 6 days b. item 23a (Specialty Number & Title) – "64B2O HVY VEH DR," c. Item 30 (Remarks) – "ITEM 22C - KOREA 3 JUN 67 – 2 JUL 68" and USAREUR [U.S. Army Europe] 26 AUG 68 – 1 NOV 69 11. Army Regulation 635-5 (Separation Documents) does not recognize the Imjin Scout Certificate as an authorized entry on military personnel records. In addition, the regulation states to enter a single primary MOS code number, title, and date of award, in item 23a (Specialty Number & Title) of the DD Form 214. BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents and evidence in the records. The Board considered the applicant’s statement, his record of service, the entries on his DA Form 20, DD Form 214 and other documents in the records. The Board found that the applicant was awarded MOS 11B and served in that MOS for more than 12 months, and then he was awarded MOS 64B. The Board found that the applicant’s last name is spelled as he requests on his DD Form 214. The Board found that the requested Imjin Scout Certificate was not an authorized document for inclusion of the DD Form 214. Based on a preponderance of evidence the Board determined that a correction to the DD Form 214 to show the applicant’s 11 B10 MOS was appropriate. The Board concurs with the corrections stated in the Administrative Note(s) below. 2. After reviewing the application and all supporting documents, the Board found that partial relief was warranted. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, in addition to the corrections stated in the Administrative Note(s) that follow, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 for the period of service ending 3 November 1969 to add to item 23a (Specialty Number & Title) – "11B10 Infantry” 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to add the Imjin Scout Certificate to his DD form 214. I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. ADMINISTRATIVE NOTE(S): a. Make the following corrections to the applicant's DD Form 214: (1) item 8 (Place of Birth), (2) Item 24 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) to add - "Armed Forces Expeditionary Medal" and the "Korea Defense Service Medal," and b. Provide the applicant with a copy of the DD Form 214 filed in his personnel record, as this version of the form clearly shows his last name is spelled as he requested on his application and his foreign service in Korea and Germany annotated in item 30 (Remarks). REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. The regulation states the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. The DD Form 214 is of vital importance to the separating Soldier and must be properly prepared according to prescribed guidance. The regulation states that an entry will be made on the DD Form 214 to show the primary MOS code number, title, and date of award, in item 23a (Specialty Number & Title) 3. 2nd Division Regulation Number 672-3 (Decorations, Awards, and Honors – Imjin Scout Certificate) serves as the authority for, and establishes the criteria and procedures for, awarding the Imjin Scout Certificate for participation in DMZ operations. It provides, that the Imjin Scout Certificate provides special recognition to members of the 2nd Infantry Division and members of units in support of Division operations engaged directly in DMZ missions.
