ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 27 June 2019 DOCKET NUMBER: AR20180014495 APPLICANT REQUESTS: in effect, correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty), for the period ending 2 July 2009, to show her primary military occupational specialty (MOS) and training. APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * Four-page document entitled "Joint Services Transcript" FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states her records do not indicate she completed training and that she spoke with the G-1 (unknown) department who verified she had. She would like it reflected on her DD Form 214 and records. 3. The applicant enlisted in the Maryland Army National Guard (MDARNG) on 15 January 2008 for training in MOS 25U (Signal Support Systems Specialist). 4. Orders: 8199010, issued by the Baltimore Military Entrance Processing Station, Fort George G. Meade, MD, dated 17 July 2008 ordered her to initial active duty for training (IADT) at Fort Jackson, SC with a report date of 12 August 2008 and advanced individual training for MOS training at Fort Gordon, GA on 27 October 2008. 5. The applicant's record contains a DA Form 199 (Physical Evaluation Board (PEB) Proceedings), which shows a PEB was convened on 22 June 2009 for chronic lower back pain that found her unfit for continued military service. 6. The applicant was honorable released from active duty and discharged from the Reserve of Army and transferred to the MDARNG on 2 July 2009 by reason of disability, severance pay (non-combat related). She completed 10 months and 21 days of net active service. Her DD Form 214 shows the entry of "None" in both item 11 (Primary Specialty) and item 14 (Military Education). 7. The applicant provides as evidence a four-page document entitled "Joint Service Transcript (JST)," classified as "Unofficial." The JST is an evaluation of a Soldier's professional education and experiences by the American Council on Education to recommend potential equivalency credits to institutes of higher civilian education. This document does not contain any credit applied based on the applicant's contention of holding MOSs 25U. 8. A staff member contacted the Signal School at Fort Gordon, GA who verified that the applicant, as a member of the ARNG, was a student from 27 October 2008 through 5 March 2009, graduated and was awarded MOS 25U (see Army Training Requirements and Resources System snippet). 9. Army Regulation 635-5 (Separation Documents), dated 15 September 2000, directed the codes and titles of all MOS's served in for at least 1 year, with the number of years and months served, to be entered in item 11 at the time of separation. For item 14 list formal in-service (full-time attendance) training courses successfully completed during the period of service covered by the DD Form 214. Include title, length in weeks, and year completed. This information is to assist the soldier in job placement and counseling; therefore, do not list training courses for combat skills. BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents and evidence in the records. The Board discussed the applicant’s statement, the circumstances of her discharge and the correspondence from the U.S Army Signal School that confirms the applicant’s completion of the requested course and award of MOS 25U. The Board determined that the evidence supports a correction to the applicant’s record. 2. After reviewing the application and all supporting documents, the Board found that relief was warranted. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending her DD Form 214 ending on 2 July 2009 by deleting from item 11 (Primary Specialty) the entry "NONE//NOTHING FOLLOWS" and adding “25 U Signal Support Systems Specialist, 4 Months and deleting from item 14 (Military Education) the entry "NONE//NOTHING FOLLOWS" and adding “Signal Support Systems Specialist (25U) 18 Weeks I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. ADMINISTRATIVE NOTE(S): Not Applicable REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), dated 15 September 2000, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. a. It established standardized policy for preparation of the DD Form 214. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty, providing a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. b. Item 11 of the DD Form 214 documents the codes and titles of all MOS's served in for at least 1 year, with the number of years and months served. For time determination, 16 days or more count as a month. Time spent in basic training and advanced individual training are not counted. c. Item 14 of the DD Form 214 states to list formal in-service (full-time attendance) training courses successfully completed during the period of service covered by the DD Form 214. Include title, length in weeks, and year completed. This information is to assist the soldier in job placement and counseling; therefore, do not list training courses for combat skills.
