The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, that the number listed in item 3 (SSN) on his DD Form 214 is incorrect, and he has no SSN listed in his military records. 3. His DD Form 214, in item 3 reflects the applicant’s service number. 4. A review of his military records shows all of his documents list his service number. No SSN is reflected in his record. 5. The applicant provides a copy of his social security card, which lists his SSN as “XXX-XX-XXXX, and a letter from HRC denying his request to correct his DD Form 214 to show his SSN instead of his service number. 6. Army Regulation 635-5 (Separations Documents), states the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. Item 3 states to transcribe the applicant’s SSN at the time of his separation from applicable documents. However, it appears that instead of his SSN, his service number was used. BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents and evidence in the records. The Board considered the applicant’s statement, the period during which he served where the Service Number was the primary means of identification, the Selective Service Number shown in his records and the lack of his SSN anywhere in his records, the Social Security Card he provided, the letter from Army Human Resources Command, and the entries on his DD Form 214. The Board did not find an issuance date for the applicant’s SSN and he did not provide that information or verification from the SSA. The Board determined, by preponderance of evidence, that there was no error or injustice related to the entries on the applicant’s DD Form 214 at the time of his separation. 2. After reviewing the application and all supporting documents, the Board found that relief was not warranted.
