Specifically, he requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his rank/grade as sergeant (SGT)/E-5 and that he was awarded the Bronze Star Medal. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20140002525 on 2 October 2014. 2. The Board will not consider the portion of the applicant's request that relates to adding the Bronze Star Medal to his DD Form 214 as this contention will be addressed through an administrative correction. 3. The applicant states the ABCMR, in his previous case, changed his rank and grade but did not annotate the change on his DD Form 215, dated 20 November 2014 and he would like it to be reflected on a new DD Form 215 along with his Bronze Star Medal. 4. The applicant's previously submitted application to the Board, dated 27 January 2014 did not list his rank and grade as a contention for relief. 5. The applicant enlisted in the Regular Army on 30 September 1966. 6. The applicant was honorably released from active duty on 5 May 1969. The DD Form 214 he was issued shows in: a. Item 5a (Grade, Rate or Rank), the entry "SP4 (T)" representing he was a specialist four (temporary) at the time of his release from active duty. b. Item 5b (Pay Grade), the entry "E4" representing his pay grade at the time of his release from active duty. c. Item 6 (Date of Rank), the entry "24 Jul 68" representing he was promoted to the rank/grade in items 5a and 5b on 24 July 1968; the last promotion prior to being separated from active duty. 7. A review of Docket Number AR20140002525 shows paragraph 6 of the Consideration of Evidence section and paragraph 1 of the Discussion and Conclusions section referred to the applicant as a SGT/E-5. 8. A thorough review of the applicant's record failed to show any documentation or evidence of him being recommended for or being promoted to the rank/grade of SGT/E-5 during his period of military service. Unfortunately, the aforementioned referral of him as a SGT/E-5 in the previous ABCMR case was a typographical/administrative error. 9. Army Regulation 635-5 (Separation Documents), dated 23 January 1967 prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. a. Item 5a, enter grade in which serving at time of separation, indicating whether permanent or temporary. Example: "MSG (P)" or "MSG (T)." b. Item 5b, enter pay grade, e.g., "E-8" or "E-4." c. Item 6, enter date of rank for the grade shown in item 5a. If grade at time of separation is not permanent, the permanent grade, date of appointment, and date of rank, if different from date of appointment, will be entered in item 30 (Remarks). BOARD DISCUSSION: 1. The Board reviewed the applicant’s request and documents in the available record. His records contain orders for the Bronze Star Medal and it will be added as an administrative correction. In spite of the reference to his grade as SGT/E5 in previous ABCMR proceedings, there is no evidence of his recommended for or being promoted to SGT/E5 during the period of service on his DD Form 214. The Board determined the reference to this grade in previous ABCMR proceedings was, unfortunately, an administrative error and did not constitute an ABCMR decision to correct his records to show SGT/E5. 2. After reviewing the application and all supporting documents, the Board found that relief was not warranted. The Board further determined the evidence presented is insufficient to warrant the requested relief. As a result, the Board recommends denial of so much of the application that pertains to amending his records to reflect his grade as SGT/E5. 2. The Board determined that based on the orders in the record that the applicant’s DD Form 214 should be administratively corrected as noted below. ADMINISTRATIVE NOTE(S): General Orders Number 7959 issued by Headquarters, 101st Airborne Division, APO San Francisco, dated 22 October 1968 awarded him the Bronze Star Medal for the period 1 January 1968 to 31 August 1968. As a result, amend his DD Form 214, for the period ending 5 May 1969 by adding the Bronze Star Medal.
