BOARD DATE: 28 February 2020 DOCKET NUMBER: AR20180015184 APPLICANT REQUESTS: Removal of an erroneous temporary change of station (TCS) order and related documents from his official military personnel file (OMPF). APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * Orders Number UZ-255-003, dated 12 September 2017, issued by Headquarters (HQ), 85th Support Command * Orders Number UZ-255-003 (A1), dated 12 September 2017, issued by HQ, 85th Support Command * Orders Number UZ-255-003 (R), dated 6 August 2018, issued by HQ, 85th Support Command FACTS: 1. The applicant states the 85th Support Command published erroneous TCS orders and submitted these orders into his permanent record. The orders are erroneous in that he had executed a permanent change of station from the organization hierarchy on or around 45 days prior to the orders published date. After notifying the 85th Support Command of their error, the organization published a revocation order and had it submitted into his record. He is requesting removal of the original order, the amendment, and the revocation order in order to clean up his record. 2. The applicant was appointed a Reserve commissioned officer on 10 May 1996. He entered active duty in an Active Guard Reserve status in July 2006. He was promoted to the rank of lieutenant colonel on 1 January 2015. 3. Orders issued by the U.S. Army Human Resources Command (HRC) on 17 April 2015, directed the applicant's reassignment to the 3rd Battalion, 337th Training Support Battalion, with a reporting date of 19 May 2015 with duties as the commander. 4. Orders issued by HRC on 12 April 2017, directed the applicant's reassignment to the U.S. Naval War College with a reporting date of 24 July 2017. 5. On 12 September 2017, the HQ, 85th Support Command published Orders Number UZ-255-0003 directing the applicant's deployment in a TCS status with a reporting date of 1 November 2017. On the same date, the 85th Support Command published Orders Number UZ-255-0003 (A1) amending Orders Number UZ-255-0003 by adding an accounting code. 6. On 1 May 2018, HRC published orders releasing the applicant from assignment to the U.S. Naval War College and reassigning him to the Pentagon with a reporting date of 16 July 2018. 7. The applicant's records contain a DA Form 1059 (Service School Academic Evaluation Report) that shows he attended the U.S. Naval War College from 14 August 2017 to 15 June 2018. 8. On 6 August 2018, the 85th Support Command published Orders Number UZ-255-0003 (R) revoking Orders Number UZ-255-0003, dated 12 September 2017. 9. A review of the applicant's record in the HRC's Interactive Personnel Electronic Records Management System confirmed that Orders Number UZ-255-0003, the Amendment, and revocation orders are currently filed in his OMPF. 10. A document from obtained from the HRC website and maintained by the Army Soldier Records Branch, titled Required Documents per Army Regulation 600-8-104 (Army Military Human Resource Records Management (AMHRR)) contains a list of currently active forms and documents required for filling in the AMHRR. The list shows that TCS orders, amendment to TCS orders, and revocation of orders are to be filled in the Soldier's service/finance/ folder the their OMPF. BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents and evidence in the records. The Board considered the applicant’s statement, his record of service, the TCS orders in the records, the amendment to the TCS orders and the revocation and the applicant’s HRC orders to the Naval War College coincident with the Support Command orders for deployment. The Board found that the TCS orders were erroneous considering the applicant’s attendance at the Naval War College. Based on a preponderance of evidence, the Board determined that a correction to the applicant’s records was necessary. 2. After reviewing the application and all supporting documents, the Board found that relief was warranted.
