The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, it means a lot to his children that they see the requested items recorded in his record. 3. The available records are sufficient as a basis for administratively correcting the applicant's record by filing the DA Form 638, Army Commendation Medal Certificate, and Certificate of Training in his Army Military Human Resource Record maintained in the interactive Personnel Electronic Records Management System (iPERMS). These records are also sufficient to confirm his eligibility for the National Defense Service Medal. The Board will not consider these issues. The Board will consider his request for correction of his record to show he was awarded the Army Good Conduct Medal. 4. On 30 May 1991, the applicant was discharged from his status as a Reserve Officers' Training Corps cadet in the U.S. Army Reserve to accept a commission. 5. Effective 6 December 1991, he was appointed as a commissioned officer in the Texas Army National Guard. 6. Effective 23 September 1995, he was separated from the Texas Army National Guard and transferred to the U.S. Army Reserve Control Group (Reinforcement). 7. Effective 29 October 1999, he was honorably discharged from the U.S. Army Reserve. 8. The available records do not show the applicant completed a period of continuous enlisted active Federal service of a period of more than 1 year. 9. Army Regulation 600-8-22 (Military Awards) states the Army Good Conduct Medal is awarded to enlisted members who distinguish themselves by their conduct, efficiency, and fidelity. Any one of the following periods of continuous enlisted active Federal military service qualifies for award: each 3 years completed on or after 27 August 1940 or, for the first award only, upon termination of service on or after 27 June 1950 of less than 3 years but more than 1 year. BOARD DISCUSSION: After review of the application and all evidence, the Board determined there is insufficient evidence to grant relief. The applicant’s contentions were carefully considered. The analyst of record provided previously stated relief in the administrative notes below. Regulatory guidance provides the AGCM is awarded to enlisted members who meet certain criteria. The applicant’s record is absent evidence he served as an enlisted member. The Board agreed he is not eligible for the AGCM. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 states the National Defense Service Medal is awarded for honorable active service for several defined periods, including the period 2 August 1990 and 30 November 1995. During this period members of the Selected Reserve in good standing were authorized this award. 3. Any one of the following periods of continuous enlisted active Federal military service qualifies for award: each 3 years completed on or after 27 August 1940 or, for the for first award only, upon termination of service on or after 27 June 1950 of less than 3 years but more than 1 year. 4. The U.S. Army Human Resources Command maintains a list of documents required for filing in the Official Military Personnel File in iPERMS.
