ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 30 September 2019 DOCKET NUMBER: AR20180016260 APPLICANT REQUESTS: correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show he enlisted on 5 October 1976 under the Delayed Entry Program. APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: DD Form 149 (Application for Correction of Military Record under the Provisions of Title 10, U.S. Code, Section 1552). FACTS: 1. The applicant states his enlistment date shown as 4 February 1977 is in error. 2. His records contain a DA Form 3286-40 (Statements for Enlistment – Delayed Entry Program), dated 4 October 1976, showing his date of enlistment in the Regular Army was scheduled for 4 February 1977. 3. His DD Form 4 (Enlistment or Reenlistment Agreement – Armed Forces of the United States), dated 5 October 1976, shows in: a. Section II (Agreements), item 10, he enlisted in the U.S. Army Reserve on 5 October 1976 for a period of 6 years in pay grade E-1 for enlistment in a Regular Component; b. Section VII (Change of Status – for Participant in Delayed Enlistment Program), item 31, in connection with his enlist in the U.S. Army Reserve on 5 October 1976, he requested to be discharged therefrom and enlisted in the Regular Army for a period of 3 years effective 4 February 1977; and c. Section VII, item 36, he enlisted in the Regular Army on 4 February 1977 for a period of 3 years in pay grade E-2. 4. He was honorably released from active duty on 30 January 1980. His DD Form 214 shows in: * item 12a (Date Entered Active Duty This Period) – 4 February 1977 * item 12b (Separation Date This Period) – 30 January 1980 * item 12c (Net Active Service This Period) – 2 years, 11 months, and 27 days * item 12e (Total Prior Inactive Service) – 3 months and 29 days (the period he was in the U.S. Army Reserve Delayed Entry Program from 5 October 1976 through 3 February 1977) BOARD DISCUSSION: 1. After reviewing the application and all supporting documents, the Board found the requested relief is not warranted. 2. The Board concluded the entry date recorded in block 12a of the applicant's DD Form 214 is correct and there is no basis for changing that entry based on his prior service in the Delayed Entry Program. 3. Although the Board found no basis for granting relief in this case, the Board agreed that making the entry described in the administrative notes below would be appropriate. ADMINISTRATIVE NOTE(S): Add to item 18 (Remarks) of the applicant's DD Form 214: "Delayed Entry Program: 5 October 1976 to 3 February 1977." REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers upon retirement, discharge, or release from active duty service or control of the Active Army. It established standardized policy for preparing and distributing the DD Form 214 and stated the DD Form 214 is a summary of a Soldier's most recent period of continuous active duty.
