ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 31 May 2019 DOCKET NUMBER: AR20180016703 APPLICANT REQUESTS: correction of his DD Form 214 (Certificate of Release or discharge from Active Duty) to reflect the troop schools he attended. APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: DD Form 149 (Application for Correction of Military Record) FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states that none of his troop schools are listed on his DD Form 214. He further states that after enduring years of injustice, he finally wants to set the record straight. 3. A review of the applicant’s records shows the following on: * 23 November 1981 – enlisted in the Army delayed entry program * 30 December 1981 – enlisted in the regular Army for four years * 16 November 1982 - awarded military occupational specialty 13B (ammo handler) * 13 January 1983 – assigned as a 13B * 24 April 1985 – separated from service and credited with 3 years 3 months and 25 days of active service 4. DA Form 2-1 (Personnel Qualification Record) reflects the following information: a. In Section VII (Record of Assignments) - * 16 March 1982 – attended 96B AIT course * 7 May 1982 – attended the 71L AIT course * 12 August 1982 – attended the 13E AIT course * 1 November 1982 – attended the 13B AIT course b. Section II (Civilian Education and Military Schools) - * 1982 - 71L course/not completed * 1982 – 13E course/not completed * 1982 – 13B course/completed 5. The applicant's record is void of any documentation nor does the applicant provide documentation that indicates he completed 71L or 13E training. 6. AR 635-5 (Administrative Separation Procedures) states to enter service schools, including major courses which were successfully completed and military sponsored courses completed in civilian schools and colleges during period covered by the DD Form 214 being prepared. a. Table 2-1 states that block 11 should contain the primary Military Occupational Specialty (MOS) or Area of Concentration (AOC), and all additional MOS/AOC served for a period of one year or more, during Soldiers continuous active military service. For each MOS/AOC, list the title with the years and months served. The above specialties must be validated on the DA Forms 2A, 2-1, or the Officer Record Brief. Any additional skill identifiers validated must be entered here or in block 14 under military education, if applicable b. Table 2-1 states that block 14 should contain the service training courses successfully completed during this period of service. BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents and evidence in the record. The Board discussed the evidence that shows the applicant’s attendance and completion of the 13B course, but not the other requested schools. The Board determined that the evidence is sufficient to support a portion of the applicant’s request. 2. After reviewing the application and all supporting documents, the Board found that partial relief was warranted. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 for the period of service ending 24 April 1985 to reflect in item 14 completion of FA CRMN (13B) 8Wks 1982. 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to adding any additional military training to his DD Form 214. I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case.
