ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 13 August 2019 DOCKET NUMBER: AR20180016813 APPLICANT REQUESTS: correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge), item 23a (Specialty Number and Title) for the period ending 16 May 1972 to show his primary military occupational specialty (PMOS) as 71U2O (Card and Tape Writer) instead of PMOS 94B2O (Food Service Specialist). APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DD Form 214 FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, his MOS was changed because he was not a very good cook. He was reassigned to the finance division, where he was trained, and was finally discharged as a finance officer. His DD Form 214 shows that he was discharged from the 107th Finance Division at Fort Bragg, NC. 3. His DD Form 214 shows: a. Item 12 (Last Duty Assignment and Major Command) - "107th Finance Company TUSA." b. Item 23a shows his MOS as 94B2O (penciled in item 23a is the entry "LAST SPECIALTY 72H2O (Central Officer Operations Operator)." c. Item 23b (Related Civilian Occupation and Dot Number – "313.168 EXECUTIVE CHEF." 4. A review of his military records shows: a. A Technical and Language Training Diploma, which reflects he satisfactorily completed the prescribed course of study for Key Punch Operator, dated 14 June 1969. (He received this training before his enlistment). b. A DD Form 4 (Enlistment Contract – Armed Forces of the United States), in which he enlisted into the Regular Army on 5 November 1969. Item 17 (PMOS/AFS Code/MOD) reflects his PMOS as a "09B00 [Basic Trainee]." c. Special Orders Number 24, issued by Headquarters, United States Army Training Center, Infantry, dated 24 January 1970, which lists his MOS as 94A1O, and shows he was being assigned to Company A, 30th Military Police Battalion, United States Army Transportation Corps (USATC) Infantry, Fort Ord, CA. d. Special Order Number 142, issued by Headquarters, 301st Army Security Agency Battalion (Airborne Corps), Fort Bragg, NC, which awarded him PMOS 94B2O, and withdrew PMOS 94A1O, effective 6 August 1970. e. A Certificate of Training, reflects he successfully completed the "Cook’s Course C-121" at Fort Bragg, NC, on 27 August 1970. f. Special Orders Number 69, issued by Headquarters XVIII Airborne Corps and Fort Bragg, dated 9 April 1971, which assigned him to the 107th Finance Disbursing Section, with a reporting date of 22 April 1971. g. Special Orders Number 87, issued by Headquarters Command, U.S. Army Garrison, Fort Bragg, NC, which awarded him the SMOS 73C2O, and the additional MOS (AMOS) of 71U2O, and promoted him to specialist five (SP5)/E-5 in his SMOS 73C2O, effective 10 August 1971. 6. His DA Form 20 (Enlisted Qualification Record), shows in: a. Item 22 (MOS’): * PMOS – "94B2O Cook – 6 Aug 70" * SMOS – "73C2O [Finance Specialist] Pay Disb Spec 10 Aug 71" b. Item 27 (Military Education) – "Cook’s Course C-121 94B – 4 weeks – 1970." c. Item 38 (Record of Assignments) – he was assigned to the following units: * 29 January 1970 to 21 April 1971: 94A/B Cook (OJT), Company A Troop Command, Fort Ord, CA. * 22 April 1971 to 16 May 1972: 71U40 – Key Punch Operator, 107th Finance Company, Fort Bragg, NC. 7. Army Regulation 635-5 (Separation Documents), states the PMOS will be entered in item 23a of DD Form 214. 8. On 16 May 1972, the applicant was honorably transferred the U.S. Army Reserve (USAR) Control Group to complete his Reserve obligation. 9. Letter Orders Number 10 1302611, issued by the Office of the Adjutant General Reserve Components Personnel and Administration Center, dated 28 October 1975, shows he was honorably discharged from the USAR, with an effective date of 1 November 1975. This document shows his rank and MOS as "SP5 94B2O." BOARD DISCUSSION: After review of the application and all evidence, the Board determined that there is sufficient evidence to grant full relief. The record indicates that item 23a and 23b of the applicant’s DD Form 214 is incorrect and does not reflect the applicant’s service in the 73C20 MOS.
