ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS I BOARD DATE: 6 August 2019 DOCKET NUMBER: AR20190000035 APPLICANT REQUESTS: correction to his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to make the following changes: * item 12 (Last Duty Assignment and Major Command) - show the entry, “TRP B, 1st Sqn., 17th Cav., 82nd Airborne Div., Fort Bragg, NC 28307” instead of “TRP B, 1st Sqn., 17th Cav., 3d US Army” * item 25a (Specialty Number and Title) - to add the entries, (131) Armor Crewman, (05B) Radio Operator, (11D) Reconnaissance Crewman, (112.17) Heavy Weapons Infantry, and any other Military Occupational Specialties (MOS) he obtained during his military service * item 32 (Remarks) - to show his social security number (SSN) as * “XXX-XX-XXXX” instead of “XXX-XX-XXXX” APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant's request for the correct duty assignment and major command in item 12 and correct SSN in item 32 will be addressed through an administrative correction and does not require action by this Board. The Board will consider the applicant's request to add additional MOSs in item 25a. 3. The applicant states, in effect, he wants all MOSs that he obtained during his military service added to item 25a. 4. The applicant enlisted in the Regular Army on 15 February 1962 and obtained the (131) Armor Crewman MOS. 5. The applicant’s DA Form 20 (Enlisted Qualification Record) shows he obtained the (112.17) Heavy Weapons Infantry MOS in 19 June 1964. The (112.17) Heavy Weapons Infantry MOS is also shown as his primary MOS and (131) Armor Crewman MOS as his Secondary MOS. 6. Special Orders 145, issued by Headquarters 82 Airborne Division Fort Bragg, North Carolina, 20 June 1964 show the applicant’s primary MOS as (112.17) Heavy Weapons Infantry. 7. Special Orders 34, issued by Headquarters, XVIII Airborne Corps and Fort Bragg, 11 February 1965 show the applicant’s primary MOS as (112.17) Heavy Weapons Infantry. 8. The applicant’s record is void of orders or documentation awarding him the primary (05B) MOSs Radio Operator, (11D) Reconnaissance Crewman, or any other primary MOSs during his military service. 9. On 15 February 1965, the applicant was honorably released from active duty. Item 25a of his DD Form 214 records his MOS as (112.17) Heavy Weapons Infantry. 10. Army Regulation 635-5 (Personnel Separations and Separations Documents) states a Soldier’s primary military occupation specialty will be entered in item 25a. There is no provision to add additional primary, secondary, or duty MOSs. BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents and evidence in the records. The Board considered the applicant’s statement, his period of service, the regulations at the time and the absence of evidence showing him being awarded any other MOS in addition to 11C2P and 11E2P. Based on a preponderance of the evidence, the Board determined that a correction to the applicant’s record was appropriate. The Board concurs with the corrections stated in the Administrative Note(s) below. 2. After reviewing the application and all supporting documents, the Board found that partial relief was warranted. ? As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending the applicant’s DD Form 214 for the period of service ending 15 February 1965 as follows: add to item 32 (Remarks) – Secondary MOS: 131 Armor Crewman. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. The regulation states the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. The DD Form 214 is of vital importance to the separating Soldier and must be properly prepared according to prescribed guidance. The regulation states that an entry will be made on the DD Form 214 to show the primary MOS code number, title, and date of award, in item 23a (Specialty Number & Title).
