The applicant states he initiated contact with the Army Medical Department (AMEDD) Center and School G-1 office in a timely manner, and should not be penalized for the shortcoming. Special Pay Branch indicated special pay contracts that are submitted late and cross into a new fiscal year must be approved by the Army Board for Correction of Military Records (ABCMR). He is requesting payment for the months of July, August, and September 2018, after becoming board certified on 1 July 2018. 2. A review of the applicant’s service records show the following on: * 14 September 2012 – the applicant was appointed as a Regular Army commissioned officer in the AMEDD Specialty Corps and executed an oath of office * 5 May 2012 – the Degree of Bachelor of Science was conferred upon the applicant * the applicant’s records are void of any evidence of a post-baccalaureate degree, likewise it is void of any board certifications * 11 July 2019 – an open source internet check of the Texas board of Physical Therapy Examiners website revealed the applicant has a current active license as a Physical Therapist 3. The applicant provides: * Texas Board of Physical Therapy Examiners Certificate showing the applicant was licensed as a Physical Therapist * MFR, Subject: Subject: Request Army Correction of Military Records for Special Pay with an effective date of 1 July 2018 wherein the author stated a series of administrative oversights have caused a delay in the processing of the applicant’s special pay request, and the applicant was not at fault for the delay * American Board of Physical Therapy Specialties Certificate showing the applicant was board certified as a Physical Therapist effective 1 July 2018 * Memorandum, Subject: Request for HPO BCP showing the applicant applied for the HPO BCP effective 1 October 2018 and expiring on 30 June 2028 at a rate of $6,000.00 per year and an AMEDD G-1 official approved the request 4. Title 37 United States Code (USC): a. Section 335 (Special Bonus and Incentive Pay Authorities for Officers in Health Professions) states the Secretary concerned may pay a health professions bonus to an officer of the uniformed service who accepts a commission and agrees to remain on active duty in a health profession. The Secretary concerned may also pay BCP. b. Section 302c (Special Pay: Psychologists and Non-Physician Health Care Providers), provides guidance related to eligibility for NPBCP, an incentive to retain high-quality health care providers in the Military Departments. Subsection (d) provides that eligibility for NPBCP is limited to those officers: * in the Medical Service Corps of the Army designated as a non-physician health care provider * who are health care providers in a clinical specialty that is privilegeable * who have a post-baccalaureate degree in their clinical specialty * who are certified by a professional board in their clinical specialty BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents, evidence in the records and a memorandum for record from the ACSHR/G-1. The Board considered the applicant’s Board Certification Date and the advising official’s conclusion that the delay in processing of his request for specialty pay was not the fault of the applicant. Based on the preponderance of evidence, the Board determined that an injustice had occurred and the applicant should be entitled to Non-Physician Board Certification Pay (NPBCP) effective 1 July 2018. 2. After reviewing the application and all supporting documents, the Board found that relief was warranted.? As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected to show his eligibility for Non- Physician Board Certification Pay (NPBCP) effective 1 July 2018 and paying him retroactively for the months of July through September 2018.
