The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states that he served during the Southwest Asia Conflict in 1991 as a 13B (Artillery). As his unit advanced, he experienced small arms fire and mortar rounds to their position. 3. The applicant enlisted in the Regular Army on 2 January 1990. He completed one station unit training and was awarded military occupational specialty (MOS) 13B (Cannon Crewman). He served in Saudi Arabia from 7 January to 11 May 1991. 4. His DA Form 2-1 (Personnel Qualification Record – Part II) does not show an entry listing the CIB in item 9 (Awards and Decorations). Item 35 (Record of Assignments) shows he performed duties as a Cannoneer while assigned to Battery C, 4th Battalion, 5th Field Artillery. 5. On 14 December 1992, he was released from active duty. His DD Form 214 does not show the CIB. 6. Based on Army Regulation 600-8-22, there are three requirements for award of the CIB. The Soldier must be an infantryman satisfactorily performing infantry duties, he must be assigned to an infantry unit during such time as the unit is engaged in active ground combat, and he must actively participate in such ground combat. The CIB is authorized for award for the Southwest Asia Conflict (17 January to 11 April 1991). BOARD DISCUSSION: After review of the application and all evidence, the Board determined there is insufficient evidence to grant relief. The applicant’s contentions were carefully considered. The Board agreed there is no evidence to support the applicant served in MOS 11B during the period in question. Regulatory guidance does not allow the awarding of the CIB to personnel in MOS 13B.
