The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states there is no indication of his combat service as a result of Operation Urgent [Fury] Grenada on October 25, 1983 while assigned to B Company, 82d Combat Aviation Battalion, Fort Bragg, NC. Also his DD Form 214 does not show his Excellence in Competition Badge Award for rifle competition while he was assigned to Headquarters & Headquarters Company, 82d Airborne Division. 3. The applicant enlisted in the Regular Army on 27 October 1980. He completed one station unit training (OSUT) at Fort Benning, GA and was subsequently assigned to Fort Bragg as his first duty station. 4. Permanent Orders #42-1, issued by Headquarters, U.S. Army Training Center, Fort Benning, GA on 4 March 1981 awarded the applicant the "Excellence-in- Competition Badge - Bronze - Rifle" for individual marksmanship performed in the 1981 Fort Bragg Commander's Rifle Excellence-in-Competition Match at Fort Bragg on 4 November 1981. The authority was listed as Army Regulation 672-5-1 (Military Awards), paragraph 5-33 [Excellence in Competition Badge]. 5. The applicant's DA Form 2-1 (Personnel Qualification Record – Part II) shows the following entries in: a. item 5 (Overseas Service), that he served in the Republic of Korea from or about 29 December 1986 to on or about 24 December 1987, a period of 11 months and 26 days; b. item 9 (Awards, Decorations & Campaigns), contains the entries "AFEM [Armed Forces Expeditionary Medal] (Grenada) and "ECB-B" [presumed to mean the Excellence-in-Competition Badge – Bronze]; and c. item 27 (Remarks), contains the entry "DY (duty) IN IMMINENT DANGER PAY AREA (GRENADA) (25 October 1983 to 4 November 1983); and d. item 35 (Record of Assignments), that he served with B Company, 82d Combat Aviation Battalion, Fort Bragg from on or about 22 October 1982 through on or about 3 February 1985. 6. Permanent Orders 8-110, issued by Headquarters, 82d Airborne Division, Fort Bragg, dated 17 January 1984 awarded him the Army Commendation Medal for meritorious achievement during operations in Grenada during the period 24 October 1983 through 2 November 1983, a period of 9 days. 7. The applicant was honorably discharged on 26 May 1990 after completing 9 years and 7 months of net active service. The DD Form 214 he was issued shows in: a. Item 12f (Foreign Service), the entry "00 11 26." b. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized), contains no entry showing the AFEM or the Excellence-in- Competition Badge - Bronze - Rifle. 8. The applicant provides in addition to what was discussed above: a. DA Form 4980-18, shows he was awarded the Army Achievement Medal for meritorious achievement as a shooter during the United States Army Commander's Eastern Region Rifle, Pistol, and Machine Gun Championships from 20 March 1982 to 2 April 1982 as promulgated by Permanent Orders 137-16 dated 23 August 1982 (contained in his official military personnel file). b. DA Form 4980-14 (Army Commendation Medal Certificate), dated 17 January 1984 shows he was awarded the Army Commendation Medal for meritorious achievement in connection with military operations in the country of Grenada from 24 October 1983 to 2 November 1983. c. A Certificate of Service, issued by Headquarters, 82d Airborne Division certifying he deployed to the country of Grenada during the period 25 October 1983 to 4 November 1983. 9. Army Regulation 635-5 (Separation Documents), dated 2 October 1989, states for: a. item 12f, enter the total amount of foreign service completed during the period covered by the DD Form 214; b. item 13, entries will be for all periods of service. Check Soldiers' service records for validity of awards. Do not abbreviate when listing the entries; and c. this version did not provide for the listing of a Soldier's deployment in item 18 (Remarks) section during this period covered by the DD Form 214. 10. Army Regulation 635-8 (Separation Processing and Documents), currently in effect, states for an active duty Soldier deployed to a foreign country with his or her unit during their continuous period of active service, the statement "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD - YYYYMMDD)" will be entered in item 18 (Remarks). 11. Army Regulation 672-5-1, dated 18 September 1989, states for: a. The Armed Forces Expeditionary Medal (AFEM) is authorized for US military operations, US operations in direct support of the United Nations, and US operations of assistance for friendly foreign nations. The AFEM was authorized for Operation Urgent Fury – Grenada from 23 October 1983 to 21 November 1983 with the qualifying criteria established for non-unit direct support personnel in Grenada is 6 consecutive days or 12 nonconsecutive days or to be engaged in actual combat, or duty which is equally as hazardous as combat, during the operation with armed opposition, regardless of time in the area. b. Chapter 5 (Badges and Tabs) awarded the Excellence-in-Competition Badges to individuals in recognition of an eminent degree of achievement in target practice firing with the standard military service rifle or pistol. A bronze Excellence-in- Competition Badge will be awarded to Army competitors who earn their first credit points regardless of credit value. A silver Excellence-in-Competition Badge will be awarded an individual when 20 credit points have been earned. All badges consist of a bar, clasp, and pendant and are identical in design except for clasp which is crossed pistols for pistol matches and crossed muskets for rifle matches. BOARD DISCUSSION: After reviewing the application and all supporting documents, the Board found that relief is warranted. The applicant’s DD Form 214 should be corrected to show: a. Adding to item 13 the entries "Armed Forces Expeditionary Medal" and "Excellence-in-Competition Badge - Bronze - Rifle" b. Adding to item 18 the entry "SERVICE IN GRENADA FROM 19831024 - 19831102". c. Deleting from item 12f the entry "00 11 26" and replacing it with the entry "01 00 04". ? Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), dated 2 October 1989, prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214. The version in effect at the time did not provide for the listing of a Soldier's deployment in the Remarks section during the period covered by the DD Form 214.
