APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD * DD Form 149 (Application for Correction of Military Record) FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states that she is missing the middle part of her service (January 1999) and that she did not receive a DD Form 214 (Certificate of Release or Discharge from Active Duty) for her foreign service in Honduras. Further, none of her awards are listed on her DD Form 214. 3. A review of the applicant’s record shows: * she served in the U. S. Army Reserve (USAR) prior to enlisting in the Regular Army (RA) on 23 September 1998 * Section E (Awards and Decorations) of her Enlisted Record Brief, dated 27 April 2000, contains the following entries – * Army Service Ribbon (ASR) (typed) * "AFM" (handwritten entry) * "Joint Meritorious Award" (handwritten entry) * "Humanitarian Ribbon" (handwritten entry) * She was discharged from the RA on 12 September 2000 4. Her DD Form 214 for the period 23 September 1998 through 12 September 2000 shows: * her last duty assignment was with Headquarters, 62nd Engineer Battalion, Fort Hood, TX * no foreign service * she was awarded or authorized the ASR and the Marksman Marksmanship Qualification Badge with Rifle and Grenade Bars 5. Her Defense Finance and Accounting Service (DFAS) records do not reflect the completion of any foreign service. 6. Information from the Center for Military History does not show that the applicant's unit conducted military training exercises in Honduras between 1996 and 2000. 7. There is no evidence that the applicant participated in exercise in Honduras while serving in the USAR or RA. BOARD DISCUSSION: After review of the application and all evidence, the Board determined there is insufficient evidence to grant relief. The applicant’s contentions were carefully considered. The applicant received a DD Form 214 covering the period 23 September 1998 through 12 September 2000 that shows her authorized awards and decorations. Her contention she did not receive a DD Form 214 for her service in January 1999 has no merit. Her record is void of any information showing deployed overseas. Based upon the evidence of record, the Board agreed there is no error or injustice. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation (AR) 600-8-22 (Military Awards) contains a list of approved operations for which the Humanitarian Service Medal is authorized. This regulation lists Operation Amigo, which occurred during the period 13 May 1990 through 19 May 1990, as the only operation in Honduras authorized this award. 3. AR 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214. It states that for Regular Army Soldiers deployed with their unit, or Reserve Soldiers called to active duty, enter deployment information in item 18 (Remarks).
