ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS IN THE CASE OF: BOARD DATE: 22 February 2019 DOCKET NUMBER: AR20190001097 APPLICANT REQUESTS: Correction of his DD Form 214 (Report of Separation from Active Duty) to show: * he graduated from Jumpmaster/Airborne School * he graduated from Armor School * award of the Parachutist Badge * he was assigned to Headquarters and Headquarters Battery (HHB), 18th Airborne Corps Field Artillery, Fort Bragg, NC APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DD Form 214 FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states: a. he attended and graduated from Jump School (Airborne) around March 1975 at Fort Bragg, NC and was awarded an Airborne badge. However, it is not on his DD Form 214. b. he has no way of proving that he was Airborne. He also made a jump in his unit and he knows there is a record of it somewhere. c. he also attended and graduated from Armor School, but this is not in his records. d. his unit was HHB, 18th Airborne Corps Field Artillery at Fort Bragg, NC. He needs to have record of this information as soon as possible. 3. The applicant enlisted in the Regular Army on 22 January 1974. 4. Special orders published on 21 June 1974 awarded him primary military occupational specialty (MOS) 76Y2O (Supply Clerk). 5. His DA Form 2-1 (Personnel Qualification Record - Part II) is marked as a “TEMP RECORD” indicating the original document was lost. This DA Form 2-1 shows the following data: * item 6 (MOSs) - no entry indicating he was awarded a special qualification identifier (SQI) of "P" (Parachutist) * item 9 (Awards, Decorations, and Campaigns) - no entry showing the Parachutist Badge * item 17 (Civilian Education and Military Schools) - no entries showing he completed Jumpmaster/Airborne School or Armor School * item 35 (Record of Assignments) - he was assigned to HHB, 18th Airborne Corps Field Artillery, Fort Bragg, NC, from 9 July 1974 to 8 September 1975 as a Supply Clerk * item 35 - he was reassigned to Battery A, 1st Battalion, 73rd Field Artillery, Fort Bragg, NC, on 9 September 1975 and he continued to serve with this unit as a Supply Clerk until he was discharged on 9 March 1976 6. His service record is void of evidence that shows he attended Jumpmaster/Airborne School or qualified as a Parachutist. There is also no evidence that shows he graduated from Armor School. 7. There is no evidence that shows he completed the prescribed proficiency tests while assigned or attached to an airborne unit or the Airborne Department of the Infantry School or participated in at least one combat parachute jump. There are no orders in his service record that show he was awarded the Parachutist Badge. 8. On 9 March 1976, he was discharged. His DD Form 214 shows: * item 11 (Last Duty Assignment and Major Command) - he was assigned to Battery B, 1st Battalion, 73rd Field Artillery, at the time of his discharge * item 16a (Primary Specialty Number and Title) - no entry showing he held a parachutist SQI of "P" to indicate he completed Airborne training * item 26 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) - no entry that shows he was awarded or authorized the Parachutist Badge * item 27 (Remarks) - no entries showing he completed basic Airborne training, Jumpmaster Course or graduated from Armor School 9. His service record does not indicate he was assigned to HHB, 18th Airborne Corps Field Artillery at the time of his discharge on 9 March 1976. 10. The Army regulation governing preparation of the DD Form 214 in effect at the time provided that: a. Item 27 (Remarks) of the DD Form 214 will list only formal in-service training to assist the Soldier in job placement and counseling and training courses for combat skills are not authorized to be listed on the DD Form 214. b. The last assignment and major command will be entered in item 11 of the DD Form 214. He was assigned to Battery B, 1st Battalion, 73rd Field Artillery, Fort Bragg, NC at the time of his discharge and this unit was entered in item 11 of his DD Form 214. BOARD DISCUSSION: After review of the application and all evidence, the Board determined there is insufficient evidence to grant relief. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards) states award of the basic Parachutist Badge requires that an individual must have satisfactorily completed the prescribed proficiency tests while assigned or attached to an airborne unit or the Airborne Department of the Infantry School or have participated in at least one combat parachute jump. 3. Army Regulation 635-5 (Separation Documents) at the time established the standardized policy for preparing and distributing the DD Form 214. a. Item 11 - enter last assignment and major command. b. Item 27 - the remarks section will be used for entries authorized by HQDA for which a separate item is not available on the DD Form 214 and to complete entries too long for their respective blocks. List formal. in-service training courses successfully completed during this period of service.
