The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states she is in the process of applying for an increase in her Department of Veterans Affairs disability rating and she noticed the discrepancies while completing her documentation. 3. The Board will only address the portion of the applicant's request pertaining to the Army Achievement Medal. The other portions of the applicant's request will be addressed via administrative corrections and by providing her a copy of her two DD Forms 214. 4. Item 9 (Awards, Decorations & Campaigns) of the applicant's DA Form 2-1 (Personnel Qualification Record – Part II) does not contain and entry for the Army Achievement Medal. 5. Her military record did not contain a recommendation for or orders authorizing her award of the Army Achievement Medal. 6. Neither the applicant's DD Form 214 (Report of Separation from Active Duty) for the period 14 June 1974 through 12 June 1977 nor her DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period 13 June 1977 through 9 March 1987 reflect the Army Achievement Medal. 7. Army Regulation 600-8-22 (Military Awards) states with all personal decorations to include the AAM, formal recommendations, approval through the chain of command, and announcement in orders are required. BOARD DISCUSSION: After review of the application and all evidence, the Board determined there is insufficient evidence to grant relief. The applicant’s contentions were carefully considered. The analyst of record provided information in the administrative notes below on several record corrections. The applicant’s record is absent evidence she received an AAM and she did not provide any supporting documents. Based upon the evidence of record, the Board agreed there is no information to support adding the AAM to her separation document. The applicant will be provided with copies of her DD Forms 214 for the periods ending on 12 June 1977 and 9 March 1987 and her DD Form 215 (Correction to DD Form 214). REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards) states the Army Achievement Medal is awarded to members of the Armed Forces of the United States, who while serving in a noncombat area on or after 1 August 1981, distinguished themselves by meritorious service or achievement.
