BOARD DATE: 1 October 2020 DOCKET NUMBER: AR20190001903 APPLICANT REQUESTS: in effect, the following corrections to his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 18 January 2002: * items 11 (Primary Specialty) by deleting replacing his Primary Military Occupational Specialty (PMOS) 19F4O (Cavalry Scout) and replacing it with 19D4H (Cavalry Scout) * item 14 (Military Education) by adding all of the schools he attended with graduation dates APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * 2 pages of his DA Form 2-1 (Personnel Qualification Record) * DD Form 214 FACTS: 1. The applicant did not file within the three-year period provided in Title 10, United States Code, section 1552(b); however, the ABCMR conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The Board will not consider the portion of the applicant's request pertaining to the correction of his PMOS, as this item will receive an administrative correction. 3. The applicant enlisted in the U.S. Army National Guard on 26 February 1980. 4. The applicant entered active duty on 17 September 2001. He was honorably released from active duty on 18 January 2002. Item 14 of his DD Form 214 contains the entry "NONE." 5. On 31 October 2002, the applicant was honorably transferred to the U.S. Army Reserve Control Group (Retired). The National Guard Bureau Form 22 (Report of Separation and Record of Service) contains the following information in item 12 (Military Education) – * 62E Heavy Equipment Operator, 9 weeks, 1980 * Basic Noncommissioned Officer Course - Reserve Component (BNCOC –RC), 2 weeks, 1982 * Instructor Training Course (ITC) -RC Certification, 1 week, 1988 * Army National Guard Battle Skills, 2 weeks 1989 * Tactical Army Combat Service Support Computer System - Tracking Head Trainer (TACCS THT), 2 weeks, 1992 * Advanced Noncommissioned Officer Course (ANCOC) – RC Phase I, 2 weeks 1993 * ANCOC – RC Phase IIA, 2 weeks 1994 6. The applicant provides excerpts (pages 1 and 2) of his DA Form 2-1 wherein item 17 (Civilian Education and Military Schools) contains the same information as reflected on item 12 of his NGB Form 22. 7. Army Regulation 635-5 (Separation Documents), then in effect, states to list formal in-service (full-time attendance) training courses successfully completed during the period of service covered by the DD Form 214. BOARD DISCUSSION: 1. After reviewing the application and all supporting documents, the Board found that partial relief is warranted. 2. The Board concurred with the correction described in Administrative Note(s) below. 3. The Board noted that the regulation governing preparation of the DD Form 214 provides that full-time training courses completed during the period of active duty service covered by the DD Form 214 will be recorded in item 14 of the DD Form 214. The Board found no evidence indicating the applicant completed any full-time training courses during the period 17 September 2001 to 18 January 2002, the period covered by the DD Form 214 he seeks to have corrected. As such, the Board determined the entry "none" in item 14 of the DD Form 214 in question is not in error or unjust. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by making the correction described in Administrative Note(s) below. 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains to adding entries to item 14 of his DD Form 214 for the period ending 18 January 2002. ADMINISTRATIVE NOTES: make the following administrative correction to item 11 of the applicant's DD Form 214: * delete the entry "19F4O CAVALRY SCOUT – 16 YRS 2MOS" * add the entry "19D4H CAVALRY SCOUT – 16 YRS 2MOS" REFERENCES: 1. Title 10, United States Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the 3 year statute of limitations if the Army Board for Correction of Military Records (ABCMR) determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents), then in effect, established the standardized policy for preparing and distributing the DD Form 214. The purpose of the separation document is to provide the individual with documentary evidence of his or her military service. It is important that information entered on the form should be complete and accurate. a. The Soldier's military education is obtained from the Soldier's records. It shows the formal in-service (full-time attendance) training courses successfully completed during the period of service covered by the DD Form 214 and includes title, length in weeks, and year completed. b. For the PMOS, enter the titles of all MOSs served for at least 1 year and include for each MOS the number of years and months served. For time determination, 16 days or more count as a month.
