The applicant states in pertinent part: * she is requesting Column c (Retirement Points) of the DA Forms 1380 be changed from "P" paid to "N" not paid but completed duty * and the numbers in Column c changed to "N" for the DA Forms 1380 dated 12 February 2012 and 26 February 2002 * she believes the DA Forms 1380 are in error because the approvers did not know the correct way to complete them for non-paid duty * she didn't know how to properly complete the forms either * rather than the approver putting an "N" in Column c for non-paid duty, they put a "P" * some of the DA Forms 1380 only contain a number in Column c for the number of hours she worked for retirement points only * she was made aware of this repetitive error during a retirement points review on 17 May 2018 * she talked to a Human Resources Assistant at the Army Human Resources Command and was informed the DA Forms 1380 could not be counted towards her retirement until they were corrected 2. The applicant's service records contain a DA Form 71 (Oath of Office - Military Personnel) wherein she was sworn in as a Reserve Commissioned Officer on 12 May 1990. 3. The applicant received her 20 year letter on 16 June 2011 and was transferred to the retired list on 8 March 2019. 4. The applicant provides her DA Forms 1380 and her USAR Retirement Points list. The following dates on her DA Forms 1380 are not present on her Retirement Points list: * 6 May 2018 - 4 Hours * 10-18 October 2016 - 8 Hours per day * 31 August 2016 - 8 Hours * 6 February 2013 - 4 Hours * 21-22 April 2007 - 8 Hours per day * 5-6 May 2007 - 8 Hours per day * 4 January 2003 - 8 Hours * 20-21 December 2001 - 28 total Hours (Travel to St. Louis, Missouri) 5. The applicant provides her itinerary for her trip to St. Louis, Missouri to account for the time on her DA Form 1380. 6. Army Regulation 140-185 (Training and Retirement Point Credits and Unit Level Strength and Accounting Records) prescribes the types of training and activities for which retirement points are authorized and the procedures for recording retirement point credits and training for U.S. Army Reserve (USAR) soldiers. Paragraph 3-3b, states a DA Form 1380 will be prepared for a unit soldier who performs equivalent training or additional training. The code“ P” or“ N” will be entered in item 10c before the retirement point credit. The code“ P” indicates the soldier is entitled to inactive duty pay for the duties performed; the code“ N” indicates the soldier is entitled to retirement point credit only. BOARD DISCUSSION: 1. The Board carefully considered that applicant’s request, supporting documents and evidence in the records. The Board considered the applicant’s DA Forms 1380 and found that not all points were annotated on her Retirement Points Worksheet. The Board determined, by preponderance of evidence, that an error was present, the periods of service on the DA Forms 1380 she provided should reflect “N” in item 10c and that she is entitled to additional retirement point credits. 2. After reviewing the application and all supporting documents, the Board found that relief was warranted. Paragraph 2–2, states retirement points may be earned by USAR soldiers for active duty (AD), or while in an active Reserve status, for active duty for training (ADT), initial active duty for training (IADT), involuntary active duty for training (involuntary ADT), annual training (AT), and inactive duty training (IDT). Types of IDT are: * regularly scheduled unit training includes unit training assemblies (UTA), and multiple unit training assemblies (MUTA) * regularly scheduled training (RST) other than UTA/MUTA * make up assemblies for missed UTA/MUTA due to AT * equivalent training (ET) in lieu of scheduled UTA/MUTA or RST * additional training assemblies (ATA) * two-hour unit training assemblies * training of individual soldiers in nonpay status. b. Paragraph 2–4 states, personnel on AD, ADT, IADT, involuntary ADT, or AT are awarded 1 point for each calendar day they serve in one of these categories and may not be awarded additional points for other activities while in such status. Most types of IDT are covered by one of the following rules on required duration of IDT and calendar day limitations on points: * one point for each scheduled 4-hour period of IDT at UTA, RST, ET, ATA, or make up assembly maximum of 2 points in 1 calendar day * one point for each 2 hour or greater period * two-hour aggregates of shorter periods may be used, except in the case of 2- hour unit training assemblies maximum of 1 point in 1 calendar day * one point for each 2 hour or greater period * two-hour aggregates of shorter periods may be used except in the case of 2- hour unit training assemblies * award of a second point in the same day requires additional hours to bring the day’s total to a minimum of 8 maximum of 2 points in 1 calendar day * points may not be awarded under more than one of the rules above during any single calendar day c.
