APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record * DD Form 214 (Armed Forces of the United States Report of Transfer of Discharge), dated 13 September 1967 FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code, section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states: a. He was instructed in and worked in the Artillery Fire Direction Control MOS, not Field Artillery Survey. b. There were more allocations for Field Artillery Survey, so his MOS was changed for promotion purposes. 3. The applicant’s service record shows: a. On 14 September 1965, he was inducted into the Regular Army. b. His DA Form 20 (Enlisted Qualification Record) shows in item 6 (Military Occupational Specialties) – his Secondary MOS was 82C20 (Artillery Surveyor) and his Primary MOS was 13E20 (Field Artillery Operations and Intelligence Specialist). c. USAAC Form 816 (MOS Classification), dated 18 March 1968, shows the applicant’s Primary MOS was changed from 82C20 (Artillery Surveyor) to 13E20 (Field Artillery Operations and Intelligence Specialist). 4. The applicant provides his DD Form 214, in which he was honorably released from active duty on 13 September 1967 and it shows in: a. item 23a (Specialty Number and Title) 82020, Artillery Surveyor b. item 23b (Related Civilian Occupation and D.O.T. number): Surveyor c. item 25 (Education and Training Completed) does not list his MOS awarding course 5. Army Regulation 635-5 (Personnel Separations - Separation Documents) states that the DD Form 214 will reflect the conditions and circumstances that existed at the time the records were created. Item 23a and 23b will contain the Primary MOS code number, title, and date of award. If the specialty represented by the MOS has a related civilian occupation, enter in item 23b the appropriate job title and code number from the Dictionary of Occupational Titles. Item 25 will contain service schools, including major courses which were successfully completed, and military sponsored courses completed in civilian schools and colleges during period covered by the DD Form 214 being prepared. BOARD DISCUSSION: 1. After reviewing the application and all supporting documents, the Board found relief is not warranted. 2. A review of the applicant's records confirms that at the time of his release from active duty, he held Primary MOS 82C, which is recorded on his DD Form 214 in accordance with the governing regulation. The Board noted that, while the applicant may have performed duties outside of the normal scope of his Primary MOS, this is not uncommon and does not change the actual Primary MOS. Based on a preponderance of evidence, the Board determined the MOS recorded on his DD Form 214 should not be changed. ? Title 10, United States Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged failure to timely file within the 3 year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Personnel Separations - Separation Documents) states that the DD Form 214 will reflect the conditions and circumstances that existed at the time the records were created. The purpose of the separation document is to provide the individual with documentary evidence of his or her military service at the time of release from active duty, retirement, or discharge. It is important that information entered on the form be complete and accurate and reflects the conditions as they existed at the time of separation. Personnel officers will prepare and authenticate DD Form 214 (Worksheet) prior to forwarding records to the transfer facility. All available records will be used as a basis for the preparation of DD Form 214 (Worksheet), including DA Form 20 (Enlisted Qualification Record), DA Form 66 (Officer Qualification Record), and orders. Item 23a. and 23b. will contain the Primary Military Occupational Specialty (PMOS) code number, title, and date of award. If the specialty represented by the MOS has a related civilian occupation, enter in item 23b the appropriate job title and code number from the Dictionary of Occupational Titles. Item 25 will contain service schools, including major courses which were successfully completed, and military sponsored courses completed in civilian schools and colleges during period covered by the DD Form 214 being prepared.
