ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS BOARD DATE: 31 October 2019 DOCKET NUMBER: AR20190002122 APPLICANT REQUESTS: correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) with a separation date of 4 September 1967 to show his military occupational specialty (MOS) as 95B1O (Military Police) instead of 63B2O (Light Wheel Vehicle Mechanic). APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DD Form 214, dated 4 September 1967 FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, he received advanced individual training at Fort Gordon, GA for MOS 95B1O. He contends he never received training for MOS 63B2O. He was recently suspended from his security job when a background check, which included a review of his separation documents did not provide evidence of his MOS as a military policeman. The review was the first time he was required to provide his DD Form 214, which he believes item 23a (Specialty Number and Title) erroneously list his MOS as 63B2O. The MOS error or injustice he believes exist has caused him to be suspended from his job and he now request a speedy response. 3. On 3 December 1965, the applicant was inducted into the Regular Army. He completed basic training while assigned to Fort Knox, KY and advanced individual training for MOS 95B1O while assigned to Fort Gordon, GA. 4. A review of the applicant's record shows his MOS 95B1O is listed on the following: * Special Orders Number 78, United States Army School and Training Center, dated 30 March 1966 * Special Orders Number 16, 30th Military Police Battalion, dated 11 May 1966 5. Special Orders Number 90, 30th Military Police Battalion, dated 14 September 1966, shows his primary (P) MOS 95B1O and the following entry: * assigned to: Headquarters and Headquarters Detachment, 30th Military Police Battalion * report date: 15 September 1966 * special instructions: Military Police 95B1O (0) Surplus Battalion Headquarters Section 6. Unit Orders Number 31, 30th Military Police Battalion, dated 26 November 1966, shows the applicant was appointed to the temporary grade specialist four (E4) in the MOS 63B2O. His individual training record and his available records does not provide evidence which shows training for MOS 63B2O. 7. The applicant's DA Form 20 (Enlisted Qualification Record), dated 27 June 1967, shows the following entry: * item 22 (Military Occupational Specialties) – primary MOS (PMOS) 63B2O, effective date 15 September 1966 * item 33 (Appointments and Reductions) – private first class/E – 3 (P), date of rank 13 July 1966, Unit Order 19 Alpha Company 30th Military Police Battalion PSFC * item 38 (Record of Assignments) – he was assigned to Headquarters and Headquarters Detachment, 30th Military Police Battalion; MOS 63B2O effective date 16 September 1966 8. On 4 September 1967, the applicant was honorably released for active duty. His DD Form 214 is void of an entry for MOS 95B1O and shows: * item 5a (Grade, Rate or Rank) – Specialist Four (Temporary (T)) "See 30" * item 23a (Specialty Number and Title) – 63B2O * item 24 Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) – "One Year Driver Badge w/ Driver and Mechanic Bar" * item 25 (Education and Training Completed) – "None" * item 30 (Remarks) – item 5a: Private First Class/E – 3 (P); Appointed: 13 July 1966 9. Army Regulation 635-5 states the DD Form 214 is a summary of a soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge. The DD Form 214 is not intended to have any legal effect on termination of a soldier’s service. BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents and evidence in the records. The Board considered the applicant’s statement, his record of service and training completed, orders for training, entries for promotion and duty assignments on his DA Form 20 and the entries on his DD Form 214. The Board found no evidence that the applicant completed training required for award of MOS 63B. Based on a preponderance of evidence, the Board determined an error occurred and that a change to the applicant’s records was appropriate. 2. After reviewing the application and all supporting documents, the Board found that relief was warranted. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 for the period of service ending 4 September 1967 to reflect in item 23a (Specialty Number and Title) – “95B10, Military Police” vice “63B20, Wheeled Vehicle Mechanic.” I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-200 (Enlisted Personnel Management System), states, in effect, a military occupational specialty (MOS), including skill level character, which identifies the capability of an individual to perform duties required of MOS at current or higher grade and made a matter of record by classification authority by entry on DA Forms 20 and 2-1 (Personnel Qualification Record). The Commandants of Army service schools or other Armed Forces schools conducting training for qualification in an Army MOS and Training activity commanders are authorized to award MOS. Additionally, the duty MOS (DMOS) which identifies authorized manning table position to which an individual is assigned and in which he is performing duty, or the MOS of the duty he is performing if not assigned to an authorized manning table position. A soldier undergoing schooling or OJT for qualification in a new MOS will be reported in that MOS with skill level "0" as a duty MOS (not PMOS) upon entry into training and will be reported in MOS for which being trained. 3. Army Regulation 635-5 (Separation Documents), in effect at the time, prescribes the separation documents that must be prepared for soldiers. It states, in pertinent part, that the DD Form 214 is a summary of a Soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge. a. In item 23a enter primary military occupational specialty (MOS) code number, title, and date of award. In addition, enter primary MOS (PMOS) evaluation score and date of score. If the enlisted person has not received a PMOS evaluation score, enter "None". If more space is required, enter "See 30" and continue remarks in item 30. If the specialty represented by the MOS has a related civilian occupation, enter in item 23b the appropriate job title and code number from the Dictionary of Occupational Titles. If not applicable, enter "NA". b.
