APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * DD Form 214 (Certificate of Release or Discharge from Active Duty) * U.S. Army Human Resources Command (HRC) Permanent Order 318-004, dated 14 November 2018 FACTS: 1. The applicant states: a. U.S. Army Human Resources Command Permanent Order 318-004, dated 14 November 2018, which awarded the Army Superior Unit Award was issued after his discharge. b. He was a member of 21st Theater Sustainment Command, 16th Sustainment Brigade, at the time of the award. c. He was present for and participated in Anakonda 16. 2. On 3 May 2013, the applicant was appointed as a first lieutenant in the Regular Army. 3. His records contain: a. a DA Form 67-10-1 (Company Grade Plate Officer Evaluation Report) for the period 16 October 2014 to 15 May 2015 that shows he was assigned to 1st Inland Cargo Transfer Company, 18th Combat Sustainment Support Battalion. b. a DA Form 67-10-1 for the period 15 October 2015 to 17 June 2016 that shows he was assigned to Headquarters and Headquarters Company, Combat Sustainment, Grafenwoehr, Germany, at the time, and his senior rater's organization was listed as Headquarters and Headquarters, 18th Combat Sustainment Support Battalion. This evaluation report also shows he participated in Anakonda 16. 4. His DA Form 4037 (Officer Record Brief), dated 20 March 2017, shows he was assigned to Headquarters and Headquarters Company, 18th Combat Sustainment Brigade, during the period 31 March 2016 to 10 September 2017. 5. HRC Permanent Order 318-004, dated 14 November 2018, shows, in part, the Army Superior Unit Award was awarded to the 16th Sustainment Brigade for the period 1 April 2016 to 30 April 2017. Headquarters and Headquarters Company, 18th Combat Sustainment Support Battalion, and 18th Combat Sustainment Brigade were not cited for award of the Army Superior Unit Award in this order. 6. The Recent Approved Unit Awards (1987 to present) database maintained by the Awards and Decorations Branch, HRC, does not show Headquarters and Headquarters Company, 18th Combat Sustainment Support Battalion, and 18th Combat Sustainment Brigade were cited for award of the Army Superior Unit Award. 7. The applicant's available records are void of any evidence he was assigned to the 16th Sustainment Brigade for the period 1 April 2016 to 30 April 2017. 8. On 11 September 2017, the applicant was honorably released from active duty and transferred to the U.S. Army Reserve Control Group (Reinforcement). His DD Form 214 does not show award of the Army Superior Unit Award. 9. A review of the 21st Theater Sustainment Command shows the 16th Sustainment Brigade have the following subordinate units: * 16th Sustainment Brigade Special Troops Battalion * 18th Combat Sustainment Support Battalion * 39th Movement Control Battalion BOARD DISCUSSION: After review of the application and all evidence, the Board found insufficient evidence to grant relief. The Board found that the “16th Sustainment Brigade” is listed on the SUA orders number 318-004, but not the “18 CS HHC Combat Sust E1” or any other unit listed in the applicant’s record to which the applicant was assigned or attached for the period 1 April 2016 to 30 April 2017. The Board discussed that the record is absent and the applicant did not provide Leave and Earning statements, orders indicating the applicant and his unit were task organized under the 16th Sustainment Brigade during the applicable period of service, or an approved DA Form 7594 (Unit Award Recommendation) for his specific unit. It is not evident that HQDA has granted approval for award of the SUA to the “18 CS HHC Combat Sust E1”. Therefore, until such time that HQDA approves it or the applicant can provide additional substantiating evidence that he was assigned or attached to the “16th Sustainment Brigade”, he is not entitled to correction of his records to show this award. Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. The Army Superior Unit Award was established by the Secretary of the Army on 8 April 1985 to recognize outstanding meritorious performance by a unit during peacetime of a difficult and challenging mission under extraordinary circumstances. Circumstances may be deemed to be extraordinary when they do not represent the typical day-to-day circumstances under which the unit normally performs, or may reasonably be expected to perform, its peacetime mission. a. Each recommendation will be submitted on a DA Form 7594 (Unit Award Recommendation) as promptly as practicable, supported by the following data, in part: (1) A proposed narrative, naming all participating units, and the specific date and geographic location (map feature, town, province name, and so forth) of the service being recognized. (2) A list of all units assigned and attached actually present and the inclusive dates of the period of service for each unit. (3) The complete official unit designation and unit identification code must be included for each unit. b. The award elements for the Army Superior Unit Award are as follows: Army Superior Unit Award Emblem; certificate and citation; streamer (if authorized); and Army General Orders. 2. Army Pamphlet 670-1 (Guide to the Wear and Appearance of Army Uniforms and Insignia) provides the implementation procedures for wear and appearance of Army uniforms and insignia. Paragraph 20-5b states a unit award is given to an operating unit and is worn by members of that unit who participated in the cited action. Personnel who did not participate in the cited action, but who are assigned in the cited unit, are authorized temporary wear of some unit awards; only the unit awards specified in Table 20–1 are authorized for temporary wear.
