The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his DD Form 214 shows no ribbons or medals. He completed Basic Training and Advanced Initial Training (AIT). He was injured toward the end of AIT. He completed every mandatory course for military occupational specialty (MOS) 12B (Combat Engineer). After he was injured, he stayed in the Army while his paperwork was being processed for his discharge. During that time he volunteered in the armory, for charge of quarters duty, and barracks cleaning instead of going to the Warrior Transition Unit. He volunteered to stay at his company, D Company, 35th Engineers, Fort Leonard Wood, MO, to work. 3. The applicant's records are sufficient to substantiate his eligibility for the National Defense Service Medal. This decoration will be administratively added to his DD Form 214 and will not be considered by the Board. The Board will consider his request for correction of his DD Form 214 to add: * Army Achievement Medal * Army Service Ribbon * Military Outstanding Volunteer Service Medal 4. The applicant entered active duty on 22 September 2008. 5. He was injured in AIT and discharge for disability with severance pay on 13 May 2009 6. A review of his DD Form 214 and official military record does not show he was awarded an MOS or any decorations. His record does not contain a diploma or other document showing he completed all training requirements to be awarded MOS 12B. 7. Army Regulation 600-8-22 (Military Awards) states: a. The Army Achievement Medal is awarded to members of the Armed Forces of the United States, who, while serving in a noncombat area on or after 1 August 1981, distinguished themselves by meritorious service or achievement. As with all personal decorations, formal recommendations, approval through the chain of command, and announcement in orders are required. b. The Army Service Ribbon is awarded to Soldiers of the U.S. Army for successful completion of initial entry training. This includes AIT for enlisted Soldiers and branch- specific basic officer leadership course for commissioned officers. c. To qualify for award of the Military Outstanding Volunteer Service Medal a service member's volunteer service must meet the following requirements: (1) be to the civilian community, to include the military family community; (2) be significant in nature and produce tangible results; (3) reflect favorably on the Military Service and the Department of Defense; and (4) be of a sustained and direct nature. BOARD DISCUSSION: After review of the application and all evidence, the Board determined there is insufficient evidence to grant relief. The applicant’s contentions were carefully considered. The analyst of record provided an award in the administrative notes below. The applicant was discharged prior to obtaining an MOS. Regulatory guidance provides the Army Service Ribbon is awarded upon completion of IET. There is no evidence he was recommend or awarded the Army Achievement Medal Based nor the MOVSM. Based upon the evidence of record, the Board agreed to deny his request. ? ADMINISTRATIVE NOTE(S): Add the National Defense Service Medal to the applicant's DD Form 214. REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 6.
