The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states, in effect, he was assigned to Company A, 3d Battalion, 325th Infantry Regiment, Fort Bragg, NC when he deployed to Grenada in October 1983. He was not aware that Grenada was a campaign and would like the appropriate awards, CIB, combat patch, and recognition. He further volunteered for a MFO duty in Sinai, Egypt from 1984 to 1985 and would like this service reflected. 3. The applicant enlisted in the Regular Army on 18 August 1982. He completed training and was awarded military occupational specialty 76Y (Unit Supply Specialist). 4. The applicant's DA Form 2-1 (Personnel Qualification Record – Part II) shows the following information. a. Item 5 (Oversea Service), contains no entry of him serving overseas. b. Item 35 (Record of Assignments), that he was assigned to the following units: * Company A, 3d Battalion, 325th Infantry Regiment, Fort Bragg, NC from on or about 11 February 1983 to on or about 29 January 1984 * Headquarters and Headquarters Company, 27th Engineer Battalion, Fort Bragg, NC from on or about 30 January 1984 to on or about 15 August 1985 5. The applicant was honorably released from active duty on 16 August 1985. The DD Form 214 he was issued shows he was credited with completing two years, 11 months, and 29 days of net active service. His DD Form 214 shows in: a. item 12f (Foreign Service), the entry "0000 00 00," representing no credited foreign service time; b. item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized), he was awarded or authorized the: * Army Good Conduct Medal * Army Service Ribbon * Parachutist Badge * Expert Marksmanship Qualification Badge with Rifle Bar (M-16) and Grenade Bar c. item 18 (Remarks), contains the entry "None." 6. The applicant's record is void of any orders or evidence that he served in an Infantryman MOS (11 series). 7. The applicant provides: a. A Headquarters, 82d Airborne Division – Certificate of Service certifying that the applicant deployed with the 82d Airborne Division to the country of Grenada during the period 25 October 1983 to 4 November 1983, a period of 11 days. This certificate was issued by the Commander, 3d Battalion, 325th Infantry Regiment and Commander, 82d Airborne Division. b. An application for the MFO Medal, dated 3 December 1984 requesting the MFO Medal, wherein it states/shows he served as a Stock Control Specialist for the period 1 August 1984 through 30 January 1985 as part of the MFO – Sinai, a period of 183 days. The form does not state what unit or to what exact task force he was assigned. c. An approval memorandum, dated 13 December 1984 approval memo awarding the applicant the MFO Medal by the Force Commander, dated 14 December 1984. 8. Army Regulation 600-8-22 (Military Awards), currently in effect, prescribes policy, criteria, and administrative instructions concerning individual and unit military awards. a. There are three requirements for award of the CIB. The Soldier must be an infantryman satisfactorily performing infantry duties, he must be assigned to an infantry unit during such time as the unit is engaged in active ground combat, and he must actively participate in such ground combat. b. The Armed Forces Expeditionary Medal may be awarded to Servicemembers who participate, or have participated, as members of the U.S. military units in a U.S. military operation; U.S. operations in direct support of the United Nations, and U.S. operations of assistance for friendly foreign nations. Table 2-3 provides that the Armed Forces Expeditionary Medal is authorized for designated "U.S. military operations" in Grenada (Operation Urgent Fury) from 23 October to 21 November 1983 (the qualifying criteria for non-direct support personnel in Grenada is 6 consecutive days or 12 nonconsecutive days). c. The MFO Medal was approved by DOD on 28 July 1982. In order to qualify for the award, personnel must have served with the Multinational Force and Observers for at least 90 cumulative days after 3 August 1981. Effective 15 March 1985, personnel must serve 6 months (170 days minimum) with the Multinational Force and Observers to qualify for the award. 9. Army Regulation 670-1 (Wear and Appearance of Army Uniforms and Insignia), currently in effect, prescribes Department of the Army policy for proper wear and appearance of Army uniforms and insignia. Paragraph 21-17 of this regulation prescribes the authority for authorization, periods of authorization, and manner of wear for the SSI-FWTS (commonly referred to as the combat patch). Soldiers are authorized to wear the SSI-FWTS for participation in Grenada; however, the SSI-FWTS is not an award or a decoration. 10. Army Regulation 635-5 (Separation Documents), dated 15 August 1979, states in: a. Item 12f, enter the total amount of foreign service completed during the period covered in item 12c (Net Service This Period); b. Item 13, the preparer should list all awards and decorations from the Soldier's records; and c. Item 18, for an active duty Soldier deployed to a foreign country with his or her unit during their continuous period of active service, enter the statement "SERVICE IN (name of country deployed) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)." BOARD DISCUSSION: 1. The Board carefully considered the application, the supporting documentation and evidence in the record. The Board determined, based on the evidence, that the applicant was in Grenada and is entitled to the Armed Forces Expeditionary Medal, that he served in the Sinai and an approval memo shows he was awarded the MFO Medal for his service there. The Board determined that the SSI-FWTS is not an award or decoration and that there is no evidence that the applicant had an Infantry MOS, was assigned to an Infantry Unit and participated in active ground combat; he is not eligible for the Combat Infantryman Badge. 2. After reviewing the application and all supporting documents, the Board found the relief was warranted. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. Adding SERVICE IN GRENADA FROM 19831025-19831104 and SERVICE IN SINAI FROM 19840801-19850130 to his DD Form 214 for the period of service ending 16 August 1985; b. Adding his foreign service to item 12 on his DD Form 214; c. Awarding him the Armed Forces Expeditionary Medal and adding it to his DD Form 214. 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of the application that pertains amending his DD Form 214 to show award of the Combat Infantryman Badge and the SSI-FWTS. ADMINISTRATIVE NOTE(S): Not Applicable REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards), 25 June 2015, prescribes policy, criteria, and administrative instructions concerning individual and unit military awards. a. The Combat Infantryman Badge is awarded based on three requirements. The Soldier must be an infantryman satisfactorily performing infantry duties, he must be assigned to an infantry unit during such time as the unit is engaged in active ground combat, and he must actively participate in such ground combat. Combat service or campaign credit alone is not sufficient to award the CIB. b. The Armed Forces Expeditionary Medal may be awarded to members of the Armed Forces of the United States for three categories of operations: U.S. military operations, U.S. operations in direct support of the United Nations, and U.S. operations of assistance for friendly foreign nations. Table 2-3 provides that the Armed Forces Expeditionary Medal is authorized for designated "U.S. military operations" in Grenada (Operation Urgent Fury) from 23 October to 21 November 1983 (the qualifying criteria for non-direct support personnel in Grenada is 6 consecutive days or 12 nonconsecutive days). c. The Multinational Force and Observers Medal was approved by DOD on 28 July 1982. To qualify for the award, personnel must have served with the Multinational Force and Observers for at least 90 cumulative days after 3 August 1981. Effective 15 March 1985, personnel must serve 6 months (170 days minimum) with the Multinational Force and Observers to qualify for the award. Periods of service on behalf of the Multinational Force and Observers outside of the Sinai and periods of leave while a member is serving with the Multinational Force and Observers may be counted toward eligibility for the Multinational Force and Observers Medal. If an individual has not completed a cumulative 6-month tour, then he or she is not eligible for award of the Multinational Force and Observers Medal unless the award is to be made posthumously, the member is medically evacuated due to service-incurred injuries or serious illness, or the member is withdrawn at the request of the parent government for national service reasons under honorable conditions. Qualifying time for award of the Multinational Force and Observers Medal may be lost for disciplinary reasons. 3. Army Regulation 670-1 (Wear and Appearance of Army Uniforms and Insignia) prescribes Department of the Army policy for proper wear and appearance of Army uniforms and insignia. Paragraph 21-17 of this regulation prescribes the authority for authorization, periods of authorization, and manner of wear for the SSI-FWTS (commonly referred to as the combat patch). Soldiers were authorized to wear the SSI-FWTS for participation in Grenada; however, the SSI-FWTS is not an award or a decoration. There is no provision for entering the SSI-FWTS on the DD Form 214. 4. Army Regulation 635-5 (Separation Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It provides standardized policy for the preparation of the DD Form 214 and states in: a. Item 12f, enter the total amount of foreign service completed during the period covered in item 12c (Net Service This Period); b. Item 13, the preparer should list all awards and decorations from the Soldier's records; and c. Item 18, for an active duty Soldier deployed to a foreign country with his or her unit during their continuous period of active service, enter the statement "SERVICE IN (name of country deployed) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)."
