Box 1353 APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) * Questionnaire About Military Service * DD Form 214, member copies 1 and 4 FACTS: 1. The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The Board will not consider the following portions of the applicant's requests, as these items will be addressed through an administrative correction: * foreign service in Southwest Asia * KLM-SA * KLM-KU 3. The applicant's Military Personnel Record Jacket was not available for review. This case was reviewed using documents filed in his Soldier Management System (SMS) electronic record and provided by the applicant. 1. 4. The applicant participated in the Delayed Entry Program from 5 June 1987 through 15 September 1987, and entered on active duty on 16 September 1987. 5. The Defense Manpower Data Center (DMDC) compiled the Desert Shield/Desert Storm Data Base. The primary Desert Shield/Desert Storm file contains one record for each active duty member who participated in-theater between 1 September 1990 and 31 July 1991 and one record for each Reserve/National Guard member or retiree who was activated or federalized in response to Desert Shield/Desert Storm. The Desert Shield/Desert Storm Database shows he served in Southwest Asia from 1 October 1990 to 31 July 1991. 6. On 15 September 1991, he was honorably released from active and the DD Form 214 provided by the applicant shows in: * Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) that she was awarded or authorized the: * Army Service Ribbon * AAM * Army Good Conduct Medal * OSR * Southwest Asia Service Medal with two bronze service stars * National Defense Service Medal * Item 19a (Mailing Address After Separation): list "P.O. Box 1353" 7. His record is void of orders awarding him the ARCOM or a second AAM. 8. The applicant did provide, and the available record does not contain, evidence of completion of a second overseas assignment during the period covered by the DD Form 214. 9. The mailing address listed on the applicant's DD Form 214 is the only address found in his record. 10. Regulatory guidance prescribes: * all awards must be announced in orders * the OSR is awarded for successful completion of overseas tours * the mailing address entered in Item 19a of the DD Form 214 is provided by the Soldier * the DD Form 214 will reflect the conditions and circumstances that existed at the time the records were created * BOARD DISCUSSION: 1. The Board reviewed that applicant’s request and documents in the record. The Board determined that administrative corrections were warranted as noted below. The record did not contain, nor did the applicant provide evidence supporting the award of the Army Commendation Medal, a second Army Achievement Medal or a second Overseas Service Ribbon. The Board did find the applicant’s requested address change to have merit. 2. After reviewing the application and all supporting documents, the Board found that partial relief was warranted. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 for the period ending 15 September 1991 to reflect the PO Box number he requests as his address after separation. 2. The Board further recommends his DD Form 214 be administratively corrected as indicated in the Administrative Notes below. 3. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. As a result, the Board recommends denial of so much of 1. the application that pertains to adding an Army Commendation Medal, a second Army Achievement Medal and another Overseas Service Ribbon to his DD Form 214. ADMINISTRATIVE NOTE(S): Army Regulation 600-8-22 (Military Awards) and is sufficient to make the following administrative corrections the applicant's DD Form 214 for the period ending on 15 September 1991 without action by the Board: * add the Kuwait Liberation Medal-Saudi Arabia and the Kuwait Liberation Medal- Kuwait in item 13 * add the entry "SERVICE IN SOUTHWEST ASIA FROM 19900901 TO 19910326 in item 18 * REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation (AR) 600-8-22 (Military Awards) states: a. The Kuwait Liberation Medal awarded by the Kingdom of Saudi Arabia (KLM-SA) was approved on 3 January 1992 and is awarded to members of the Armed Forces of the United States who participated in the Persian Gulf War between 17 January 1991 and 28 February 1991. b. The Kuwait Liberation Medal awarded by the Government of Kuwait (KLM-KU) was approved on 9 November 1995 and is awarded to members of the Armed Forces of the United States who participated in the Persian Gulf War between 2 August 1990 and 31 August 1993. c. The Overseas Service Ribbon is awarded for successful completion of overseas tours. Numerals are used to denote the second and subsequent awards of the Overseas Service Ribbon. 3. AR 635-5 (Personnel Separations - Separation Documents), prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214. It states: a. For an active duty Soldier deployed to a foreign country with his or her unit during their continuous period of active service, the statement "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD - YYYYMMDD)" will be entered in block 18 (Remarks). b. The mailing address will be obtained from the Soldier and entered in block 19a. The Soldier will be advised to provide a permanent address.
