APPLICANT'S SUPPORTING DOCUMENTS CONSIDERED BY THE BOARD: * DD Form 149 (Application for Correction of Military Record) FACTS: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20050016977 on 17 August 2006. 2. The applicant states he should have been awarded the CIB. His company commander, Captain B____, signed off on the paperwork to award him the CIB, but their company clerk failed to enter it in his military records. 3. The applicant was inducted into the Army of the United States on 25 August 1967 and was awarded the military occupational specialty (MOS) 11H (Infantry Direct Fire Crewman) on 12 January 1968, then reclassified to MOS 76P (Stock Control and Accounting Specialist) on 10 October 1968. 4. He served in Vietnam from 8 February 1968 through 29 December 1968, where he was assigned to the following units, serving in the following duty MOSs: * Company E and Company A, 4th Battalion, 47th Infantry, 9th Infantry Division, from 10 February 1968 through 8 June 1968, duty MOS 11H * Headquarters and Headquarters Company, 9th Supply and Transportation Battalion, 9th Infantry Division and 9th Administration Company, 9th Infantry Division, from 9 June 1968 through 28 December 1968, duty MOSs 76A (Supplyman) and 76P 5. He was honorably released from active duty on 22 August 1969 after 1 year, 11 months, and 28 days of net active service this period. His DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) shows he was awarded or authorized the following: * National Defense Service Medal * Vietnam Campaign Medal with Device (1960) * Vietnam Service Medal * expert Marksmanship Qualification Badge with Rifle Bar (M-14) * two overseas service bars 6. There is no evidence of record the applicant was ever awarded the CIB or that he actively participated in ground combat against the enemy. 7. His records contain a DD Form 215 (Correction to DD Form 214), which shows his records were corrected in January 2006 to show he was awarded or authorized the following: * Vietnam Service Medal with four bronze service stars * Republic of Vietnam Campaign Medal with Device (1960) * Army Good Conduct Medal * Republic of Vietnam Gallantry Cross with Palm Unit Citation * Republic of Vietnam Civil Actions Honor Medal First Class 8. He applied to the ABCMR, requesting award of the CIB and on 17 August 2006, the Board denied his request deeming the presented evidence did not demonstrate the existence of a probable error or injustice. 9. A review of the Awards and Decorations Computer Assisted Retrieval System maintained by the U.S. Army Human Resources Command Military Awards Branch, an index of general orders issued during the Vietnam era between 1965 and 1973, failed to reveal any orders for the CIB pertaining to the applicant. BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents and evidence in the records. The Board considered the applicant’s statement, his record of service, to include service in Vietnam, his DA Form 20, his MOS, duty MOS and units of assignment, the correction of his awards, the unit operational history and the reason for his separation. The Board considered the absence of orders or other evidence specific to award of the CIB. Based on a preponderance of evidence, the Board determined that the applicant should be awarded the CIB. 2. After reviewing the application and all supporting documents, the Board found that relief was warranted. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: - awarding him the Combat Infantryman Badge, Vietnam, 1968, and; - amending the DD Form 214 for the period of service ending 22 August 1969 to add to item 24 (Decorations, Medals, Badges….) – “CIB.” I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. REFERENCES: 1. Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. a. For award of the CIB, a Soldier must be an infantryman satisfactorily performing infantry duties, be assigned to an infantry unit during such time as the unit is engaged in active ground combat, and actively participate in such ground combat. b. Personnel with other than an infantry or special forces MOS are not eligible, regardless of the circumstances. The infantry MOS or special forces special skill identifier does not necessarily have to be the Soldier’s primary specialty as long as the Soldier has been properly trained in infantry or special forces tactics, possesses the appropriate skill code, and is serving in that specialty when engaged in active ground combat.
