The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552(b); however, the Army Board for Correction of Military Records (ABCMR) conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states: a. He was initially scheduled for release from active duty before he returned home from Operation Desert Shield/Desert Storm. b. He initially deployed as a volunteer to fill a vacancy in Bravo Company, 101st Airborne Supply and Transportation Battalion advance party. He then returned to his original unit, Delta Company, 101st Airborne Supply and Transportation Battalion in the late 1990s. c. It appears his records did not catch up with him between his return to the United States on 12 April 1991 and his discharge date on 29 May 1991. d. His three Army Achievement Medal Certificates issued in 1988, 1989, and 1990, as well as other records, show his deployment to Saudi Arabia. e. Award of the Overseas Service Ribbon Numeral 2 is for his deployment to Saudi Arabia. 3. The available records contain sufficient evidence to administratively correct the applicant's record to show award of the Army Achievement Medal (3rd Award), Southwest Asia Service Medal with three bronze service stars, Kuwait Liberation Medal-Kingdom of Saudi Arabia, Kuwait Liberation Medal-Government of Kuwait and his deployment to Southwest Asia from 1 September 1990 to 12 April 1991. These issues will not be discussed further in these Record of Proceedings. 4. The Board will address the applicant's request pertaining to award of the Overseas Service Ribbon with Numeral 2. 5. The applicant enlisted in the Regular Army on 9 October 1986. 6. His DA Form 2-1 (Personnel Qualification Record – Part II) shows in: a. item 5 (Oversea Service) – he served in Germany from 23 March 1987 to 28 September 1988; entry showing "Saudi Arabia," but the dates are not indicated in this block. b. item 9 (Awards, Decorations, and Campaigns) – entries for award of the: * Sharpshooter Marksmanship Qualification Badge with Rifle Bar (M-16) * Expert Marksmanship Qualification Badge with Hand Grenade Bar * Army Achievement Medal (2nd Award) * Overseas Service Ribbon * Army Service Ribbon * Air Assault Badge * National Defense Service Medal * Army Good Conduct Medal (1st Award) * 7. He provided three DA Forms 4980-18, dated 24 March 1988, 1 May 1989, and 17 October 1990, which show he was awarded the Army Achievement Medal for: a. meritorious achievement while assigned to the 1st Battalion, 7th Infantry (Cottonbalers), in Aschaffenburg, Germany, from 8 March 1988 to 24 March 1988, b. outstanding performance of duty during Exercises Logistic Eagle 89-1 and 89-2, and c. meritorious achievement from 18 August 1990 to 30 September 1990 while attached to Bravo Company, 426th Supply and Transportation Battalion during Operation Desert Shield in the Kingdom of Saudi Arabia. 8. He provided a copy of Headquarters, 101st Airborne Division (Air Assault) and Fort Campbell, Permanent Orders 156-055, dated 17 August 1989, awarding him the Army Achievement Medal with First Oak Leaf Cluster for the period 16 April 1989 to 21 May 1989. 9. On 29 May 1991, he was honorably released from active duty. His DD Form 214 shows he was awarded or authorized the: * Army Good Conduct Medal (1st Award) * Overseas Service Ribbon * Army Service Ribbon * Sharpshooter Marksmanship Qualification Badge with Rifle Bar (M-16) * Expert Marksmanship Qualification Badge with Hand Grenade Bar * Army Lapel Button * Army Achievement Medal * Air Assault Badge * National Defense Service Medal 10. Item 18 (Remarks) of his DD Form 214 does not show his deployment to Southwest Asia in support of Operation Desert Shield/Desert Storm. 11. The Defense Manpower Data Center (DMDC) compiled the Operations Desert Shield/Storm Data Base. The primary file contains one record for each active duty member who participated in theater between 2 August 1990 and 31 July 1991. This database shows the applicant served in Southwest Asia during Operation Desert Shield from 1 September 1990 to 12 April 1991. ? BOARD DISCUSSION: 1. After reviewing the application and all supporting documents, the Board found that full relief is warranted. 2. A review of the applicant's records shows he is authorized additional awards not listed on his DD Form 214. His DD Form 214 should corrected to show award of the Army Achievement Medal (3rd Award), Southwest Asia Service Medal with three bronze service stars, Kuwait Liberation Medal-Kingdom of Saudi Arabia, Kuwait Liberation Medal-Government of Kuwait, and his deployment to Southwest Asia for the period 1 September 1990 to 14 April 1991. ? Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the ABCMR to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 600-8-22 (Military Awards) states the Overseas Service Ribbon was established by the Secretary of the Army on 10 April 1981. Effective 1 August 1981, all members of the Active Army, Army National Guard, and Army Reserve in an active Reserve status are eligible for the award for successful completion of overseas tours. The award may be awarded retroactively to those personnel who were credited with a normal overseas tour completion before 1 August 1981 provided they had an Active Army status on or after 1 August 1981. Numerals are used to denote the second and subsequent awards of the Overseas Service Ribbon. 3. Army Regulation 614-30 (Overseas Service) prescribes policies pertinent to overseas permanent change of station moves, overseas tour lengths, overseas tour curtailments, time-on-station, eligibility for overseas service criteria, voluntary and involuntary overseas tour extension, the Overseas Tour Extension Incentive Program, and consecutive overseas tour. Table 3-2, paragraph 6, states that Soldiers who serve a minimum of 11 cumulative months (within a 24 month period) or 9 continuous months in a temporary change of station/temporary duty status may receive overseas tour credit for a completed short tour. 4. Army Regulation 635-5 (Separation Documents) in effect at the time established the policies and procedures for completion and distribution of the DD Form 214. It stated that item 18 is used for entries required by Headquarters, Department of the Army, for which a separate block is not available and for completing entries that are too long for their blocks. Paragraph 18(f)(2) states the entry "SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD - YYYYMMDD)" will be entered in item 18 for active duty Soldiers deployed to a foreign country with their unit.
