The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant enlisted in the U.S. Army Reserve (USAR) on 31 July 1961. His enlistment document shows his name as "xx___, xx____ (NMI)" and he authenticated this document with a signature in this name. 3. The applicant was ordered to active duty training on 30 August 1961. He was honorably released from active duty training back to the USAR on 28 February 1962. Item 1 (Last Name – First Name – Middle Name) of his DD Form 214 lists his name as " XX___, XX____." 4. The available military records do not record the name he requests. 5. The applicant provides a copy of his driver license, social security benefit statement and certificate of marriage which lists his name as he requests, "XX__, XX___ Jr." 6. The DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents and evidence in the records. The Board discussed the applicant’s statement, the name he consistently used throughout his period of service and verified by his signature and the post-service documents that show a name change. The Board determined that there was insufficient evidence to make the requested change to the record. The Board further noted that a copy of this decision will be placed in the applicant’s record to clarify the difference between he used during his service and the name he uses now. 2. After reviewing the application and all supporting documents, the Board found that relief was not warranted.
