The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The Board will not consider the following portions of the applicant's requests, as these items will be addressed through an administrative correction: * Purple Heart * DOB 3. The applicant states his DD Form 214 shows an incorrect permanent address. 4. A review of his military record shows that the applicant completed honorable service in the Regular Army from 23 September 1966 through 20 September 1968. 5. His record is void of an address in Burleson, TX. 6. The applicant provides his TX Driver's License, which lists a Burleson, TX, address as his current address. 7. There is no regulatory provision to amend the permanent address listed on the DD Form 214 after a Soldier separates from the service. BOARD DISCUSSION: After reviewing the application and all supporting documents, including the administrative notes by the analyst of record below the signature block, the Board found sufficient evidence to grant partial relief. 1. Per the administrative notes, there is sufficient evidence to grant so much of the applicant’s request that pertains to his request for the Purple Heart Medal and the date of birth. 2. However, there is insufficient evidence to grant that portion of the applicant’s request that pertains to changing his home of record address. Governing regulations require maintaining information on the DD Form 214 that reflects the applicant’s service at time of separation. The address was not intended to be changed or updated each time the individual or family member relocated following a Soldier’s release from active duty. The applicant can ensure that his address is correct for mailing purposes by updating his address at the nearest military installation’s DEERS (Defense Enrollment Eligibility Reporting System) office to change the address in his records and visit the installation’s Retirement Services Office (RSO) to make the final corrections regarding his address in DFAS. Therefore, the Board found sufficient evidence to grant partial relief in accordance with the administrative notes annotated by the Analyst of Record (below the signature), but regarding the applicant’ request to change his address on his DD Form 214, the Board recommends denial. However, the Board advises the applicant to visit the nearest military installation’s: a. DEERS (Defense Enrollment Eligibility Reporting System) office to change the address in his records, and b. Retirement Services Office (RSO) to make the final corrections regarding his address in DFAS. Correct the DD Form 214 as follows: * delete the current entry in item 9 and add the entry "10 Jun 47" * add the Purple Heart to item 24 REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separation Documents) establishes the policies and provisions for the preparation and distribution of the DD Form 214. This regulation states that item 31 should reflect the permanent address for mailing purposes furnished by the individual at time of separation.
