The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant states his HOR is . 3. On 4 June 2018, he enlisted in the Regular Army (RA). His DD Form 4 shows in: * item 3 (HOR) - "" * item 4 (Place of Enlistment/Reenlistment) - "Grafenwoehr" 4. He provides his two ERBs, which show his HOR as – * 5. Orders 101-0003, published by USAG Bavaria Transition Center, dated 11 April 2019, show the applicant has a discharge date of 26 April 2019. These orders also list his HOR as Germany. 6. Army Regulation 601-210 (Regular Army and Army Reserve Enlistment Program) states that the HOR listed on the DD Form 4 will be an address in the United States or U. S. territory. BOARD DISCUSSION: After review of the application and all evidence, the Board determined the evidence is sufficient to grant relief. The Board agreed that the applicant’s DD Form 214 incorrectly lists his home of record as Grafenwoehr, Germany vice Mira Loma, CA (as reflected on the applicant’s Enlisted Record Brief dated 20190411. This item must contain a U.S. or U.S. territorial address and cannot contain an overseas address. ? As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending the DD Form 214 (Certificate of Release or Discharge from Active Duty) item 7 (Home of Record) with the following: The applicant's home of record (as recorded on the ERB dated 20190411) as “Mira Loma, CA” vice “Grafenwoehr, Germany.” I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. ADMINISTRATIVE NOTE(S): Not Applicable REFERENCES: 1. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation (AR) 601-210 (Regular Army and Army Reserve Enlistment Program), in effect at the time, governed eligibility criteria, policies, and procedures for enlistment and processing of persons into the Regular Army and the U.S. Army Reserve for enlistment. Figure 6-1 (DD Form 1966 completion instructions) provided the following instructions for: a. Item 3 (Current Address) - Enter street, city, county, state, country and zip code. b. Item 4 (HOR Address) - Enter the street, city, county, state, country and zip code. Do not enter a temporary address. Address must be in United States or U.S. territory. 3. The Joint Travel Regulations, Appendix A (Definitions and Acronyms), defines HOR as the place recorded as the home of the individual when commissioned, appointed, enlisted, inducted, or ordered into a tour of active duty. a. The place recorded as the individual’s home when reinstated, reappointed, or reenlisted remains the same as that recorded when commissioned, appointed, enlisted or inducted or ordered into the tour of active duty unless there is a break in service of more than one full day. Only if a break in service exceeds one full day may the member change the HOR. b. Travel and transportation allowances are based on the officially corrected recording in those instances when, through a bona fide error, the place originally named at time of current entry into the Service was not in fact the actual home.
