The applicant did not file within the three year time frame provided in Title 10, United States Code (USC), section 1552 (b); however, the Army Board for Correction of Military Records conducted a substantive review of this case and determined it is in the interest of justice to excuse the applicant's failure to timely file. 2. The applicant enlisted in the Army National Guard (ARNG) on 7 August 1980. His enlistment documents list his first name as "XXXXX" and his SSN as "xxX-XX-XXXX." There is no evidence he served under the first name and SSN he now requests. 3. The applicant entered active duty training on 22 September 1980 and he was honorably released from active duty training on 6 February 1981. The DD Form 214 lists his first name as "XXXXX" and his SSN as "xxX-XX-XXXX." 4. The applicant was honorably released from the ARNG on 11 May 1983. The NGB Form 22 lists his first name as "XXXXX" and his SSN as "xxX-XX-XXXX." 5. The applicant provides a copy of his social security card which lists his first name as "XXXXX" and his SSN as "xxX-xx-xxxx", as he requests. 6. Army Regulation 635-5 (Separation Documents), then in effect, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It stated to transcribe the name and SSN at the time of separation from applicable documents. BOARD DISCUSSION: 1. The Board carefully considered the applicant’s request, supporting documents and evidence in the records. The Board considered the names and SSN under which the applicant served and the documents he signed using the name and SSN he now contests, and the SSN Card that he provided. The Board also found a different spelling of first name on the driver’s license he provided. The Board found insufficient evidence and the applicant provided no additional evidence or explanation to support a correction of his records. The Board determined that the spelling of the first name and the SSN on his DD Form 214 and NGB 22 were not in error or unjust. 2. After reviewing the application and all supporting documents, the Board found that relief was not warranted. Title 10, USC, section 1552(b), provides that applications for correction of military records must be filed within three years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the three-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. 2. Army Regulation 635-5 (Separations Documents), then in effect, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge.
